for work to be done, if a business has to have specific hours of coverage for the contracts made with clients, if the business dictates how a contractor does the work from their normal way of working, the business needs to hire employees. From the IRS 20-point factor test, "workers who must comply with your instructions as to when, where, and how they work are more likely to be employees than independent contractors."

By the way, I bet even newbies understand the terms independent and cherry picking, so please don't demean them. To net it out, if a business wants to call all the shots all the time (control), hire employees. The people yelling the loudest at this company about cherry picking are the ones who are guilty of that offense over and over, but they throw their temper tantrums to hold onto their perceived power so the rest of the MTs will shut up and do as they say. I call that hypocrisy. What would you call it?

Remember, a contractor is a business unto themselves. They make the decisions of whether they want to operate at a profit or a loss, and transcribing ESLs for which the contractor has little to no experience is operating at a loss. If the business is honest up front, they will tell the IC that the dictators, the ESLs, are horrible, and then let the IC determine whether they want to accept a contract...before the fact, not afterwards.
