My father did tax accounting for 30 years and this is what I was always told (mind you he had many companies caught by the IRS and fined, paid back taxes, etc.): They cannot control how, where, or when you perform services, as an IC. It is your company or business. Technically as an IC, you present your business to a company and what hours you can offer services to them, at what rate. They choose to accept or decline your services. They can, however, give you a "window" of time you are allowed to work in their system, but not tell you when you have to work. They can, also, request minimum lines daily or weekly, etc. They wouldn't be able to operate otherwise. That being said if they say....you may work between 3 p.m. and 3 a.m. and we would need you to produce at least 5000 lines a week, that is acceptable...but that is about all they can say. They can control the where we work in this industry also in terms of HIPPA and our internet connection and security, but that is about it.
