Has anyone had to make a complaint to the - Department of Labor

I have a major issue with my pay and have gone around and around with my company (LARGE MTSO) for a week now and keep getting excuse after excuse.  If the problem is not rectified by 5:00 p.m. tomorrow, I plan to file a complaint with the Dept. of Labor.

I'm just wondering if anyone else has ever done this and what the process is like?  I'm wondering if I do this, if I should expect to "suddenly" lose my job afterwards?

I'm just sick and tired of having incorrect pay.  You would think that one of the top MTSOs out there would be able to get it right, but no!  I just wonder if I'm the only one they are screwing over.

Not sure if this is pertinent for your state - check with them. The instance that I can discuss concerns not getting paid AT ALL...nada for over 6 months. I had to prove to the Dept. of Labor that I was first, employee, second, had copy/documentation of bounced checks, and attempts to recoup money. I was told the process would take 4-6 weeks. I was to have NO contact with employer after claim was filed. The DOL would handle all communications between me and employer. I don't know how this helps with your situation. I suggest that you contact your state DOL and ask them IF you have a case, and IF they will take the claim. Hope this helps and good luck.

owed me some back pay. They got me my money, tore apart her office, and I had the additional enjoyment of hearing they shut her down entirely.

I live in WI but the 1st MTSO I worked for is located in FL. I had to file the claim with the FL one.

My claim was basically for not making minimum wage being IC status. I had to keep on the DOL about the status of my claim. My MTSO never questioned me on it, but they are very good at covering their own behinds, so document every email, phone call, letter, etc.

It should not cost you anything to go ahead and file with the DOL, but don't expect a big payout. I'm still owed $700+ by my old MTSO for lack of proper payment, but the only way I would get it now is to hire an attorney and with what MTs make, that ain't gonna happen!

They dropped my case too. I do wish you the best of luck though, but even using the DOL to fight an MTSO is just another headache in my book. They are screwing us all over (but "legally").

I would give it more time if you want to keep your job. - Been there, done that.

I also reported a company to the DOL but it was not for money owed. They never really had a chance to act on my behalf, but I was laid off in short order. Funny, I was the only person in that company let go who got severance pay, vacation pay, and "no notice" pay.

If you do not care about keeping this job, go for it. This should be done more often.

I wish I could wait, but they are messing with my money.

This is a HUGE corporation. I'm sick of the games. And to be honest, no, I don't care if they let me go, I will be the first in line to file for UE and with all the evidence I have, I am certain I will get it.

I am tired of getting excuses and the run around. They aren't following their own policies. When I point this out, they hide....all the while holding money that belongs to me.

I was let go shortly afterwards. They said they would not fight the UE, and I did qualify. Payments started immediately.

It really does not matter what you are fighting with them, they can let you go at any time, for any reason, and with no notice. Again, that does qualify you for UE, but that is only about 50% of your income in my state.

I kinda hope you do carry through this with even if you are let go, if you are in the position to be able to do this. I wish these complaints were filed more often.

I just found out today that they were supposed to have filed an attached worker claim with the employment security commission months ago for me so that I could receive partial unemployment benefits for the weeks I don't have enough work. Today is day #3 this week that I have NO WORK at all.

It is the LAW that they file this claim and they have never done it. This, coupled with unpaid wages and unpaid PTO, is turning out to really be something much bigger than I initially thought it was. I contacted HR and informed them of this (even though that isn't my job) and then I reported them to the ESC because I know HR won't do anything about it. This afternoon I will be calling the Dept. of Labor. I will not back down and have no doubt that the reason I sit with no work is because I won't just let all this go. Why they haven't fired me yet is beyond me...that one I can't figure out yet. I'm certainly not trying to get fired (I like my health insurance) but if they aren't going to give me any work, what are they waiting for? All I'm doing is trying to make them pay me what I earned...lol.

If they fire me? No, I really don't care. I know for a fact that I would get UE, and I would certainly be making more money than I am now. I just wish others at my company would stop being so scared of them and speak up and STAND UP and do something. They are one of the worst of the worst.

I, for one, am not afraid of them and will not be pushed around anymore.

They don't fire you b/ce of the UE, which qualifies you. If you quit, you disqualify. - That is what they are waiting for. No Message

but I have been with OTI for MANY years and I have VERY SELDOM run out of work. If I got low on work, I'd ask for a backup account and usually got one. I've been working with this company for over 90 days. The first 90 days was a paid internship. Paid hourly, minimum wage. I am now a full time employee...paid on production.   However, I can not even seem to make minimum wage while on production pay! It is driving me nuts and is very discouraging. After celebrating having no make-up pay last paycheck, I have an absolutely horrific amount of make-up pay this paycheck. The difference?????? Cesspool, a lot of bad audio and even worse ASR output than the normal terrible output. Got told today that my minor error rate is above metrics.
