Do we have any employee rights? - at the end of my rope

Can someone please advise on this scenario?

You are hired with a company to do specific jobs.  For 9 months you work as hard as you can for this company, and then you are told you will need to do EVERY work type, even those you have absolutely NO experience doing.  You are told 20 minutes before your shift that this is the case, and now all you are getting is not only work types you are not familiar with, but ESL doctors on top of that.  Production PLUMMETS.

Just deal with it?  I feel like crying right now.

I'm sorry things have switched up on you and for the havoc it has created for you.

HOWEVER, the REALITY of MT today is you need to be able to do "it all." While it's nice that you were zinging along making nice production, etc, there were other MTs who don't have that option. I think your company is leaning towards where all companies will lean-- if it can be dictated, you need to know how to transcribe it. Those who continue to limit themselves in work types and/or specialties are going to have more and more difficulty finding work.

So to you question as to what to do about it.... ask for samples, keep at it. You *WILL* get faster and more experienced at the new work.

Unless you have a contract that says you are to ONLY have XX kind of work, no there's no recourse to you if you want to stay with the company.

you are very level headed right now and I appreciate it, I need to step back from the situation because I am absolutely wanting to poke my eyes out, and I am on the verge of tears like every new patient that I get...
12 years of this... and I do feel what my initial sentence says. Where is the compensation for being able to "do it all". I do not want to limit myself and I want to be good at every kind, but that's just not feasible. OMG tears. ugh deep breath IM such a baby sometimes...

You're not being a baby, your status quo has been upended. It's a natural reaction to balk at it, to rail at it, and then step back and see how to make lemonade out of the lemons.

Sadly, getting paid to "do it all" isn't really set apart from the pay of doing one work type in many companies. I make 10 at one job and 9 at another. I do what comes up and believe me, when I get an email that says- "I know you don't all do all work types so just skip what you don't do"- I cringe because I'm pretty sure those people are being paid a comparable salary.

Take a walk. Breathe. Let this begin to sit with you. Life is all about changes and knowing how to roll with those changes.

actually fortunate, even if you don't feel like it right now, and your company is being kinder rather than meaner in giving you this chance to bring your skills up to standard. You WERE in a really bad position with limited work types, even if you hadn't realized it yet, and this is the very best of the bad things that would eventually happen as a result. Like being let go and unable to get another job.

The work'll get easier and easier--fast. After all, you are an experienced MT, not a newbie. I sure don't want to start you off crying, because you do have my sympathy at having this come on you so suddenly, but you need to try out a smile or two and get that old can-do engine revved up.

Regarding your initial question about your rights, BTW, you do have plenty of legal rights as a employee, but none of them are being trampled here, so you can stop worrying that there's something you should be doing that way. Your employer is totally within its rights to ask you to do the work it needs done.

I tried to fight change to ASR reasoning that I was hired as a transcriptionist, NOT an editor.

Was told by NYS Labor Dept. that some states (including NY) are "at-will employers -- meaning employer can change your job title, duties, pay, etc. at any time.

Sorry I don't have more encouraging news ... seems we just can't fight this degrading industry at all. :-(

I am a part time employee of an MTSO. In California the min wage is $9/hr, which means at 0.85/line for editing my LPH must add up to $9, while MTs in other states may only have to make $7.50 or so to remain employed. "Surgical Notes a national provider of transcription services for ambulatory surgery centers has an immediate part time opening for a qualified QA/Proofer.  The independent contractor position will be from 8:00 AM to 12:00 PM CST Monday through Friday. Curious to know if anyone on this board is a statuatory employee with the company they are working for and outside of the company paying your SS tax and FWT, do you get any type of benefit, i.e., PTO, health, etc. Is it strictly just for tax purposes? Would you get a W2? Do you have to adhere to a schedule?
