The owner of Another Medical Must is forgetting one HUGE must: She cannot require a set schedule or mandate certain hours of an independent contractor, and her ad shows that she is doing both. She is going to have to either change her ICs over to employees and start paying the employment taxes or treat them like actual ICs with schedule flexibility. All these companies who try to treat ICs like employees when it comes to schedules, etc., but then want to treat them like ICs when it comes to paying all of the taxes associated with hiring people with employee status make me really question how well they treat the people who do their work. They seem to be the type of people who want everything their own way and want to rake all of the advantages of the business world to themselves with no thought for anyone else's rights.

I'm wondering if it would help any if we were to simply report these ads to the IRS, along with a link to the URL... Would the IRS pay any attention or would it be a waste of our time? It's just a thought, as I know that none of us can predict the result ahead of time unless one of you has done this and can report on the outcome.

to do everything we can do in this industry to help our situation. These companies just make their own rules and force us to live by them as long as they can get away with it. I know that if you work for a company and feel that you are being treated unfairly as an IC, the IRS has a form to complete, and they will look into whether the company is breaking any of the rules and regulations regarding ICs. If they are found to be breaking those rules, then they can be forced to pay your employment taxes as though you were an employee for that year and any other years you report during which they are found in violation. I'm assuming after that point, the company will have to either change all ICs to employees and/or start abiding by the rules. I know of one company that had to completely revamp and classify their workers as employees in the last couple of years. There is no way I'm going to be held to a schedule PLUS pay my own employment taxes. That's ond of the tradeoffs for being an IC. You do have to pay those employment taxes, but you have more freedom with your schedule. I mean, why would anyone agree to pay their own employment taxes PLUS be held to a schedule with no say-so over his or her own time UNLESS he or she is being forced to do those things by a company that is breaking the rules? These MTSOs are just riding rough-shod over us.

But if you are an employee, you cannot deduct your business expenses, which for me are vast along with health insurance and medical costs. With all the complaints on the boards about no work, I do know she is hiring.

Oh, I didn't mean to suggest that working as an IC is a bad thing. Some much prefer it to working as an employee. What I'm saying is that there are guidelines that companies are to follow when hiring ICs, and one of them is that they cannot mandate a schedule, and that is what the owner of Another Medical Must and many others are doing. If they want to have ICs working for them, then they should treat them like ICs; that was my point.

for PT?  I'm getting conflicting information from other employees, friends and my CCM.  CCM says no medical for PT and someone I know in HR says in CA you are eligible for medical for anything over 24 hours per week, albeit at a higher premium.   Yet another person says a company doesn't have to offer medical to anything less than FT.  Sigh......   ...

I just saw an ad for a Medical Scribe.  The description is that the MT accompanies the doc from room to room to see patients, sits at the computer in the room and transcribes the H&P/procedure while doc is doing the exam.  Starting pay was $17/hr with full benefits.  Anybody ever heard of this?  I think it's a good idea, leaves the doc hands free to tend to the patient.  It sounds a little like being a court reporter as far as "live" dictation being done. ...

Of course, this is a discharge diagnosis, so I can't just type "HUF" and leave it be.  I can't for the life of me figure out what this might be, and I can't find it anywhere.   The patient has hematuria with pancytopenia and renal failure.  This MD is not an ESL and speaks quite clearly.  He is clearly saying "HUF"!!!  (Actually he is saying HUF/TTP.) Appreciate any help with this.  Thanks.     ...
