ATSI nonpayment of wages - Paisley

This is just a warning message to hopefully prevent other MTs from going through my experience. ATSI still owes me three paychecks, which were repeatedly promised to be paid day after day, week after week, then we were informed they legally had to pay by August the 8th. Most of us have still not been paid. I just learned that David Shepherd and his wife, Terry, also control M T World. I am now employed elsewhere, but it will take months to undo the damage this company did to me, not only by not paying (financial difficulties come to companies as well as to individuals) but by not telling us the truth, which I have kept fully complete documentation of all communication with ATSI since this began. Many good, honest workers were hurt, and I would be careful of any organization associated with these people.

Forget the agent (ATSI.) You need to go after the principal for payment (the clinic or the hospital.) In all likelihood, they have a liability as well. See a lawyer. Or consider small claims court.

Huh. That's a new idea, pursue the hospital. Some of us are working through the Florida Department of Labor, some have decided to sue, some continue to attempt restitution through ATSI directly. Some money (a small amount) has been paid to some of the employees, except to those seeking to sue. I have not heard of anyone addressing the hospitals whose accounts we worked on. Thank you for the response.

I'd imagine it depends on whether the hospital paid ATSI. Can't go after them - if they already paid. nm

If the IRS has a levy against ATSI... - which it sounds like they do...

You won't get anything from the hospitals or any other ATSI clients. The principals/clinic/hospital must send every penny billed by ATSI straight to the IRS - no exceptions - until the IRS levy demand is satisfied.

However, I would suggest calling the IRS taxpayer advocate's office in your City/State. Tell them the whole picture of what is going on. There may be something they can do, as you all are owed wages. The taxpayer advocate is for us taxpayers. I used it for a revenue officer that was out of line and they kicked major butt, even went to Congress to have that revenue officer removed from the IRS. The IRS advocate office is a branch of the IRS, but gets things done PRONTO!

Small claims court will do no good - you still have to wait until the IRS gets ALL of their money... I'd bet my last dollar that ATSI and its principals will be filing BK and your judgment will go right in there with it - your judgment will be discharged without payment. They most likely will already include all of you who worked there in the BK filing from the git-go to cover their you-know-whats.

Happened to me by another company. I never saw the $10k they owed me, not a penny. To this day, they are in business and doing extremely well, despite how hard I wished they'd fail again :)

Yes, I am expecting something like that to happen. I have a new job, I am greatly valued, respected, and appreciated, and though it will take time to resolve the problems this has caused me, I will move forward. Actually the reason I posted here was to let other transcriptionists know to be careful with any company run by these people. I am a person who tries to think the best of people first, and I am not a back stabbing person, but when there is solid reason to speak up about a very bad situation, I will, and I do not want to see someone else put in this situation. I would want to know if I was employed by or looking for employment with anyone who had a past record like this. I do appreciate the tips also, though.

I have a signed contact with a company as of 3/15/2011 according to the contact payment for services is to be made within 5 business day of receipt of the invoices. I have done work for them, I have submitted my invoices to them for payment. ATSI is a bad company to work for. When hiring on they tell you 0.08 cpl then after about 2 weeks they switch you to a company called Oracle that you sign a contract with stating 0.075 cpl. When I got my second paycheck I noticed money was missing. When questioned about it they said that they pay per report 1.50 at the most. NO ONE EVER mentioned this to me at all. I would really like to know who comes up with these stupid programs that are supposed to benefit the transcriptionist. This MT World program (you work in word) is just stupid in my opinion.
