I am new to MModal, as my company just began using it not long ago.  I have been trying to calcuate how they come up with the hours they do.  For instance, we are paid hourly to use it while we "learn" it, but what my actual time is weekly is different than what it shows on the system.  For instance, I have to clock in each day and can have an hour for lunch, but yet the hours I actually clock in for are different than the hours MModal shows I have worked on it in the system.  Sometimes, it might show I worked 30 something hours and sometimes 40 something hours.  So, my question is, does it doc time off if you have to pause and look something up or if you just need to run out really quickly for something to drink or a quick restroom break.  I know this program can log your keystrokes and if you are using the shortcut keys, etc.  So, in essence, the way I look at it, we are not "really" being paid hourly.

M-Modal in specific, as well as virtually any/all other platforms, provide a plethora of information.

Most employers look at your logon/logoff time for the platform and subtract any time that was lost due to inactivity in which the system actually logged you off. I am not talking about times where you are not active and doing research but remain logged in on a report. If, however, you have reach the limit of inactivity (each employer sets that metric to their own needs) and the system logs you off and you lose the report you were working on - this would show up as an abandoned job and your logoff at XX:XX time with X minutes of inactivity.

Here's an example:
You log into your timekeeping software at 8:00 a.m. on Monday. You also log into M-Modal at 8:00 a.m.

You begin editing with continual report loading until 10:00 a.m. You decide to take a break and log off of M-Modal but not off your timekeeping software - your company may or may not decide to deduct this discrepancy (logged in for time but not for production).

Let's say, however, instead of taking a break at 10:00 you become inactive. You stepped away from the computer with a report on the screen for some reason. Maybe your company has an inactivity limit of 10 minutes. At 10 minutes a message pops up on the screen that you are about to be logged off for inactivity. You are not back at your desk in time and don't see it. It logs you off. You come back to your desk at 10:25 and log back into M-Modal and start editing again. That 25 minutes will be visible on the M-Modal production metric and your company may well dock that from your time as you were not logged in/working.

Although I'm not convinced it is a prevailing practice at the moment, I suppose it "could" and there is a small possibility it "might" become regular practice to only use active time on the keyboard in the future to determine production time.

All that brings me back to your question (my apologies for such a long road to the answer): Whether or not you are being docked for any type of inactive time on the keyboard has nothing to do with M-Modal. It has to do with how your company is using the production metrics from the platform. If you are paid by the line, you are not being paid hourly at all. They are keeping up with how much time you work due to federal overtime compensation regulations.

lph rate for straight transcribing and VR, i.e., 150 lph straight and 250 lph VR (just example, might be higher depending on company). You may or may not be able to meet these requirements hourly, depending on many variables, some of which have nothing to do with your speed. Perhaps it took you 9 to 10 hours to get your required lines each day for a given week. IF you actually put 10 hours in your timesheet for the week, that would come to 50 hours. The company cannot have that because then they would have to pay overtime by law. So,in order to prevent this from happening, requiring them to pay overtime, they calculate the hours (10) and divide that by the lines you produced, and it comes up to below their mandatory lph requirement. This puts you on the spot, knowing you could lose your job because you are not meeting their requirements. Therefore, you adjust your hours on your timesheet so it works out to the lph requirement. In order words, you fudge your actual hours worked.

I would appreciate not getting any responses saying things such as "if you can't meet requirements, it's your own fault," etc. I am not talking about slackers in my example. I am talking about MTs who are doing the best they can with all the requirements of the job that are not considered "production time", the demographics, Google searches, and horrendous dictation they have to deal with that slows them down.

What are you are describing is illegal - it is falsifying - time reports. (sm)

Your worked hours are what they are, period. If they are trying to adjust your worked hours through a production rate in order to avoid overtime, they are committing fraud and so are you by falsifying and attesting to inaccurate hours/time.

There are plenty of companies out there that do not do this. Please find a credible employer.

and it takes you more than that to get your required lines, you have to put 40 hours on your sheet, right? Plus, it might not be illegal because companies do say that they only pay for what you actually produce. They would just say it's your problem. Survival of the fittest (or fastest), in other words. The explanation given above is SOS with many companies, I believe. Maybe other MTs can chime in about this.

by law, an expensive problem for a company if overtime is not needed, with ultimately disastrous consequences for an unusually expensive MT who can't produce even the minimum required line count within a standard work time. After all, a skilled MT/ME can produce the minimum sitting on one hand and most produce a lot more. If newbies struggling to learn need more time, a bureaucratic version of "looking away" as they bring their speed up is doing them a great favor--as opposed to firing them.

there are many variables to take into account, especially with VR. I believe there was an article posted about someone involved with the M-modal platform stating that "one standard cpl rate does not fit all" or something along those lines. I think the majority of the problems comes from low compensation for our work. Unfortunately, I don't think this will ever change.

The last 3 companies I worked for all considered only keyboard - time as work time.

Why is MModal posting job openings, when so many of use are running out of work or worse falling into the pool--what with the pay cuts, VR being paid half even though it takes nearly as long to edit most reports, and the fact that I only get my "primary" accounts about 30% of the time and the rest of the time I am typing from the pool so that nearly every report that comes up is a new facility or dictator, I have gone from making $16 an hour to minimum wage. I see so many complaints about MModal. Does anyone actually like them? I'm in the hiring process and they are calling with an offer. I would like to try it out. I work in-house now, but eventually my position will be eliminated due to VR. I do not make that great of pay, and have lots of down time, but still have to sit in the office all day. I am so sick of Mmodal.  I resigned recently and I keep getting letters to return things that I have never ever owned or received or stuff that I had sent back to them years ago.  The DEPOT apparently is as ignorant as the rest of them. SO glad I found  real job that pays, respects and appreciates their employees.  I have only one PC to return and they sent me five boxes and a bunch of labels and stating that I have in my possession 7 different things.... OMG.. what a joke!!! ...

can you specify exactly what laws they have broken?  Yes, we are all unhappy here, but I cannot see that they have done anything they cannot do legally. The last judgment against them was for witholding pay.  I think they are too smart to break laws again. What do you expect to gain anyway by suing a company that has filed bankruptcy, which is always a very smart business move to make if you can get away with it. ...

It took a stupid pill.  It skips at least a fourth of the words, uses commas and back slashes like most people use salt and pepper of course skipping the words where it puts the commas in, puts in stuff that is not even close to what is dictated.  These companies pay for their stuff to be run through this ridiculous program.  Why are the bosses allowing this low quality to come through unless they own part of mmodal.  Does not make sense.   ...
