forced to use PTO? - sm

Posted: Jun 04, 2015

Can anyone tell me where the employee handbook is now located since they shut down Enrich? If anyone has a copy can you tell me or copy me the part about taking time off sick with a doctor note???

I was out last week due to being in the hospital. I had to run and get a dr note for them from the hospital, well send someone, and have it faxed pronto. I was excused for 3 days work, which I only work part time anyhow. I now get told they are forcing me to use PTO hours for those 3 days, which is 16 hours total. I only have a little over that and was going to use 10 coming up for my kid's bdays, which I already had the request in for and now wont have enough. My TSM said she spoke with HR and they told her to do that. I cannot access the employee handbook now that Enrich is down. Can someone tell me what it says please???? THANK YOU. This was a HOSPITAL note, not a doctor office note. I am about to quit.

Ask about using leave of absence....sm - mt2

I can't access the handbook either, but there is a clause in there about LOA. I used it last year for 7 days when I had a family emergency, nonmedical. You have notes from your Dr. and hospital so I don't see a problem. At the time I left, I had only 1-1/2 days of PTO and didn't have to use it.

what I found in handbook on page 21 - not sure if it helps

PAID TIME OFF (PTO)
Paid Time Off (PTO) is a multi-purpose time off policy for eligible employees to use for vacation, illness or injury, and personal business. It combines traditional vacation and sick leave plans into one flexible, paid-time-off policy.

yes i have the handbook now - and sm

I cannot find anything in there about being required to use it. I am going to inquire now about this to HR.

I would just ask to flex for your kids birthdays--sm - anon

I have not looked at the handbook but the way I have understood it in the past is you are not required to use PTO if you are OOW. For anything else, if you have the PTO available and want/need time off, you are required to use the PTO.

but its not in the handbook - sm

and I had a hospital note to be excused.

You have a note, but the note does not really mean much--sm - anon

As an at-will employee, they can let you go if they wish. The note tells them you were not just faking it but if you missed time, it is not unheard of for them to require you to use the PTO first. The using PTO if you have an absence is a pretty normal business practice. However, if it is really important to you, flexing is an option so you do not have to miss out on birthdays. That is one of the few remaining benefits of transcription, especially if you only work 20 hours. Most part time jobs give no PTO.

Did you file for short term disability? I thought that - was the only time you have to use

PTO first. If not, I would definitely ask to just have it qualified as a temporary leave of abscence.

more PTO "leave" info - from manual

"NTS requires employees to use available PTO before going into an unpaid status."

I was only out 3 days. I work 20 hours a week anyhow. I had a hospital note from the hospital excusing me. I was in the hospital for something starting on my days off and told them I was going to the hospital before I even missed work.

I don't get it - sm

You want unpaid time for the illness/hospital, but you want to use PTO for the birthdays. Why not use PTO for the hospital and take unpaid time for the birthdays? Isn't it all the same?

My guess is the greater concern is making sure she gets the time off--sm - anon

not so much about the money which is a wash, as you pointed out. Many supervisors will allow you to flex though so it really should be a non-issue in the end.

yes. - but sm

I'm not flexing. I will take the days off and will let them know. If they want to fire me for it go ahead. I put in for the 2 days off about 2 months ago I believe and now I have no time. I'm not missing my kids birthdays sorry. Also, I cannot find in the handbook. I don't see how they can make it up as they go and who is to say they treat others the exact same? It's discrimination if it is not outlined in the handbook and she wont respond to my emails. I was going to call earlier but I want it in writing. I will write again tomorrow and then start calling. I am going to consult a lawyer as well. Last time I asked for the HR's boss, I emailed and received no answer.
A lawyer? Really? Pay me instead :) - sm

I found it in the handbook, under the heading "Using PTO to Supplement Other Benefits."

I charge $600/hr and it took me 5 minutes to read the whole PTO section. You owe me $50. LOL

I would call my TSM and then send a followup email summarizing what was said. It sounds like your TSM is willing to work with you. She probably just wants to be sure she's covered with HR and doing things the way she's supposed to.
it doesn't say anything though - in that section...

I read it in mine I got a copy of this afternoon from my TSM and that just talks about disability, leave of absence, etc. Where do you see where it talks about being required to use your PTO if you are out due to illness ?? I am not arguing with you, I am truly asking where it is. No she isn't willing to work with me. She passed the buck off to HR immediately and will not answer any questions and referred me to HR. Who is not answering my emails. How nice.
The last sentence of that section says ... - sm

Substitution of Paid Leave for Unpaid Leave

whether or not I wanted to use it. I cannot find in my handbook where it says it is required to use PTO for sick time. I had a hospital note and was in the hospital. This wasn't a common cold I called off for. Anyhow- unpaid has to be approved by a manager or so I was told and only for things like sick. I did not think it was something used for desired time off for vacation, etc. Is it?? I never heard that. Again, not in the handbook either! When they deduct my time off I have almost none now. I missed 3 days. I don't have any for the rest of the year. Why not use unpaid time off for this incident since it was a hospital and I had a note, and let me use my time for birthdays? I keep reaching out to HR via email and she wont respond. They already put it in for me on my timecard.

It is not the same because they do not allow you - to take unpaid time off.

If she doesn't have PTO to cover the planned PTO then she's out of luck.

The handbook says we get 30 days of Personal Leave - nm

I Think The MTSOs Should Be Forced To Pay - Sm
Feb 18, 2012

for all MTs it has forced into poverty or joblessness because of offshoring, VR, and crummy wages to be able to return to school or job retraining FREE OF CHARGE, so we can remain gainfully employed. Most of us who've been in this biz for longer than 4 or 5 years have no hope of being able to afford to go to school.  And those of us who've been MTs longer than 20 years need help and advocacy when it comes to job placement, because currently I seriously doubt many companies would h ...

Transcend/MDI Employee Forced Out
Jan 18, 2011

The story is I worked on same account for 4 years under MDI with no complaints about my work, always went above and beyond.  I was at top of pay scale.  Then, Transcend took over a year ago and has been hiring a lot of new employees, probably at a lot lower line rate with the industry the way it is, and now I had a "random" audit done of my work and said I failed and must go thru probation.  I said "no" to probation because upon my review, I found it was not random repor ...

Since Mmodal Has Forced Us To Be As Efficient As Possible
Nov 12, 2013

I'm wondering what method do you use in DQS to get the best line count for Mmodal?  Do you mostly use the mouse/keyboard combo? Do you use the (annoying/ineffective/slow) feature that is supposed to jump the cursor to line up with the audio position where the editing needs to be done? Do you keep your right hand on the arrow keys and left hand on ctrl/alt/shift keys, moving the cursor past each word (likely the most efficient method, but moving your fingers near constant can lea ...

Why Bad EMRs Are Forced On Physicians By Edwin Leap, MD

from KevinMD website "I recently did a tally.  Since starting my locums adventure last year, and going to full-time locums in January, I’ve worked in a grand total of 11 emergency departments.  Let me qualify that for the occasional visitor to my blog.  I decided to do this for purposes of flexibility, finances and a much needed change of scenery.  Not because I’m a problem physician, or unable to do the work in a “real” job.  I say that to ...

If We Are Forced To Quit For NJA, Do We Have A Case For "constructive Discharge"?
Aug 06, 2010

This is a followup to the issue of "constructive discharge" that was brought up in a thread on this board back on August 3.  The original poster stated, and I agree after googling and checking out several sites on the topic, that an employee can claim "constructive discharge" if forced to quit because (loosely quoted from more than one site) "...the employer has made working conditions intolerable.  Issues can include...... reduction in ........workload for reasons that are not tied to ...

Work Has Dropped Off So Bad Now That I Am Forced To Look For Work Again
Feb 14, 2013

Really upset right now - work has dropped off so bad now that I am forced to look for work again.  I am upset because there was work on the system and a few of us were asked to stop so that the people that have been there the longest have a chance at work.  I dont think this is very fair as I have bills also to pay and surely cannot like this.  I thought it was first come first serve.  Am I so wrong?  ...
