The companies who recruit for full-time IC's, especially IC supervisors. - See message

If IC's are supposed to be available for other jobs, then aren't these companies just hiring for IC's as a way to avoid paying employee benefits? How do they get away with this? I'm disgusted when I see all the job openings specifically wanting IC's. It seems abusive to me.

The definition of an IC is NOT what these companies define their ICs as being. It says......"the person for whom the services are performed, have the right to control or direct only the result of the work and not the means and methods of accomplishing the result.", soooooo when they dictate "IC needed Tuesday through Saturday shift" or third shift or whatever, that's just not legal!

They are not directing the "means or methods" they are saying they have work that needs to be done on these days and at these times. ICs are free to take the job and do it, or not. Nobody says you have to sign up for a job if you don't like the hours they need to have covered, they are looking for an IC who is WILLING to work those hours. If you need work done from noon to 5 on Mon & Thurs, and someone signs a contract agreeing to do that, it doesn't make them an employee.

ICs who are roofers cannot insist on doing the work on the roof whenever they feel like it (3 am?) even though they are still ICs. Someone needing a new roof CAN insist that the work not be started until 8 am or whatever if that's what they want or need, and it's up to the roofing contractor to take the job or not. Same thing.

Does anyone care to share that if you are hired at optiscript part time will they let you change to full time easily? I know they are a small company and do not over hire so I do not know how easily this could be done. It seems to me that full-time IC is a contradiction. I mean, in order to really be an IC, per IRS, don't they indicate that you should have more than one client? So, if one client requires full-time, that means you have to work more than full-time in order to keep everyone happy?
