Minimum wage for remote employees - Anon

Posted: Feb 06, 2014

Are employees working from home governed by federal minimum wage laws, or does it vary by state? Or does it not necessarily apply at all? In other words, is an MTSO obligated by law to pay a remote employee the minimum wage for their state, regardless of the number of lines or minutes of dictation produced?  I work an 8-hour shift with a 30-minute break, i.e., 1 pm to 9:30 pm and 30 minutes of that is a break.  If I can't make the line count minimum, am I guaranteed minimum wage for those 8 hours?  What about when an employee is paid per minute of dictation, i.e., a minimum of 120 minutes of dictation daily? How does minimum wage fit into that scenario? Any info is appreciated, thanks!

Hey maybe its time for a change.org petition! - to congress - ya never know!!

What galls me is the requirement for a 'minimum' number of hours 'availability' via a set schedule but if you have no work/insufficient work you get 'nada' for compensation. Unfair. You have to be available ready to work, but then NOT work with no pay if for whatever reason they have no product to produce.

This particular scenario needs to stop. Either pay a set hourly rate with an incentive for optimum production, or remove the minimum hourly requirements/set schedules, or offer a choice.

Yes - minimum wage required by federal law for ALL hours worked - anon

As long as one is classified an employee, minimum wage for the state in which the employee lives must be paid. Overtime pay must also be paid for all hours worked in excess of 40 hours per week, or 8 hours/day in some states. That's why the DOL requires that timesheets must be kept by the employee and signed to ensure compliance.

hourly wage if were are paid on production... and how does it encompass all the UNPAID work we have to do for them?

If you can't make min. wage, by law they're - required to make up the difference.

However, as soon as they have to do that, they'll start hassling you about your hourly production. Or, they may try to get you to falsify your time sheet. Don't let that scare you, and just keep doing what you can, the best you can. Don't let them make you quit; make them lay you off.

How crazy does it make you that doing the insane demographic crap doesn't count as work? Or taking the time to properly research the spelling of a name because the dictator thinks you live in his/her neighborhood and should know how it's spelled? Or the time it takes to correct THEIR negligent errors all shift long, left instead of right, mg instead of mcg or mEq, he instead of she, Lasix 200 instead of 20, etc. etc. etc. And then the dictator calls you a typist, and says, "Typist, please insert this here." Typist? What if I called them a CNA, do you think they would mind?

If you are not making min wage with your production, your - employer should be adding in

[ In Reply To ..]
makup pay to bring you to your state's minimum wage if your employee status. The downside is, if they have to add in constantly, they usually won't keep you. The production requirement usually is put in place to force you to the minimum.

They're supposed to... but they don't ... NM - Sam

We used to never have to worry about making minimum wage before VR came in. I remember the first time I was informed when I was working for Nuance that I hadn't made minimum wage and the company would have to make it up. I had never heard of such a thing. if they hadn't lower the rates so much for VR this would have never happened to us. I just couldn't believe it, when I first heard about it. They don't like having to make up the pay so eventually your job will be in jeopardy. What a travesty that it has come to something like this, that we have to worry about even receiving minimum wage. it is just SO ridiculous. Due to this, I refuse to do VR and I am hanging in with what straight typing I can get as much as possible.
So, I work for N and mamde $4 an hour last week... - I am drained.

I give 40 hours of my life a week to this company. I want to make this craziness stop, can't we all get together SOMEHOW and force them to do something!! Can I contact my state Dept of Labor or something? People who can help need to know what is happening to us!
Something we can do..... I hope this works.... - Fading fast

I don't know if this will work, but I wrote a letter to the Attorney General's office in my state about the mistreatment of employees by this company. I did receive an answer from them stating only that they had received my email and were forwarding it to the proper division. I have not had further communication from them, but this was only about 3 weeks ago. Perhaps if everyone contacted the Attorney General in their state, it might help/work. We need to retain the standing that we are a well-respected, well-paid, dedicated and highly intelligent part of the medical field. We should never have been "demoted" to this ridiculously low level of existence! Write to every government advocate that you can and just maybe we can regain our previous standing as a well-respected, well-paid, intrinsic part of the medical community.

"Write to every government advocate that you can and just maybe we can regain our previous standing as a well-respected, well-paid, intrinsic part of the medical community. "

Are you delusional? No nevermind, this statement is delusional. Seriously. The field is changing and will NEVER be putting the genie back into the bottle. To even make the above statement is ludicrous and will do more harm to your psyche than good.

I'm curious as to why those of you not making minimum wage are still working for these companies??

We teach people how to treat us and accepting low wages and not leaving is part your responsibility, too. Yes, hold the companies accountable, but accept your REALITY and move on.

Accept my reality and move on? Move on where? I'm almost 70 years old, trying to eke out a living and keep my home, listened to my broker once upon a time and now savings are gone with no hope of retirement, nothing but my Social Security check and the "living" I make in this profession. So, tell me again, move on where?

Perhaps writing to a govermenment advocate is not the method you would choose, but I applaud that person for speaking out instead of going like a cow to the slaughter. Everyone fights back in their own way. I haven't figured mine out yet, maybe an open letter to the AMA? Maybe a class action suit? I would write to AHDI if I thought it would do a nickel's worth of good, but they are not about us anymore. They exist only for upper management and the MTSOs. Shame on them.

If you're an IC though they don't have to pay you minimum wage. Course if you're an employee, that's something that you have to worry about then.

How Many Employees Make Under Minimum Wage & Use A Time Clock?
Jun 27, 2014

I recently started working for a new MTSO and am employee-status for the first time.  We use a time clock.  My LPH is half what it should be due to the volume of horrid dictators. When that rare miracle happens and I get all good dictators for an hour my LPH double and meets requirement. My concern is:  How many are fired because they don't meet the required volume for fear of FSLA suits?  Is this still happening like it was a year ago?   What can we do when the l ...

Minimum Wage In MA And MUP
Nov 20, 2013

Massachusetts may well pass a minimum wage of $11 (over 3 years).  It's passed the state senate.  Parts of WA (Seatac) actually have a $15 minimum wage.  Wonder what Nuance will do about MUP now, since so many in those states will be getting it.  Could get interesting.  ...

DC Minimum Wage

At Least Got Minimum Wage
Dec 17, 2014

Bottom line is, regardless of the new pay rules, it's hard to even make above minimum wage before or after the new rules. So at least federal law guarantees minimum wage. Beyond that, my goal is to get out of this field and leave this MTSO company ASAP, though it won't happen overnight. ...

Minimum Wage
Jan 25, 2015

A $15.00 minimum wage would equate to 375 lines per hour at .04 per line. That's 3000 lines a day for an 8 hour day! The best I have ever done was 2700 lines editing in an 8 hour day and that was only once and someplace where I had been doing the same doctors for 6 years. Guess I would get fired for always getting MUP. And by the way, that's 428 lines per hour (3424 lines per day) at .035 per line and 500 lines per hour at 0.03 (4000 lines per day). If more cities raise the ...

Minimum Wage On Pay Stub
Jun 10, 2010

On today's check I had 0.25 hours at minimum wage, and I have no idea why. I have always produced my 150 lph minimum every day since I started. Minimum Wage Question. (sm)
Nov 14, 2011

I have heard in various places on these boards that if you are supposed to work full-time and your pay (by the line or character) doesn't equal minimum wage for those hours, you can get unemployment even though you still have a job. Does anyone know if that is true? Does it apply to part-time work? If anyone has a link to valid information, please let me know. I don't even know where to look, but I'm dying here with NJA when I'm supposed to be working, getting no response ...

SGS Pays SOME MTs Minimum Wage
Nov 27, 2011

On a post below about SGS, an MT states that she is being paid minimum wage.  She states she had to 'fight' for it, however, they are paying her minimum wage on the accounts where she is scheduled, and expected, to sit in front of her computer when there is very little work. I have asked several coworkers about this, and some of them are being paid minimum wage, as well.  Not all; only the ones who requested (demanded) it. THERE GOES ALL MTSO CLAIMS THAT SINCE WE' ...

Minimum Wage Issue Again

I was reading a post placed earlier today about minimum wage and calling employment lawyers, etc.  Why can't we all get together, hire someone to represent us (like a lobbyist) or start our own organization since AAMT bailed on us.  There is power in numbers.  We just need someone who is a leader to step forward and make this happen.  I would be willing to pay a small sum of money on my part to get something started for us to have some type of representation to get our i ...

STILL Making Just Over Minimum Wage!
Apr 04, 2012

I LOVE working from home. I love my CCM, she is extremely understanding and flexible, which is what I need! Due to this, a few weeks ago I decided I just had a "bad attitude" and needed an adjustment. So I put my nose to the grindstone and produced almost 5,000 more lines than normal or required (80 hours). I had quite a few straight transcription jobs, and was confident my paycheck for the last pay period would be awesome! Although it was approximately $70 more than normal, I still figured ...

MTSO And The Minimum Wage
Jun 25, 2012

I decided to drive to the Labor Department and ask them directly about this issue, with respect to the fact that MTs who work as employees are paid "per line." The guy said, "It doesn't matter what type of work you do, by federal law you must be paid mininum wage." --- Even if the agreement is for "per line," it must equal mininum wage. So folks ... start keeping very strict records of when you're working and ONLY when you're working. That means, if you get up to go to the ...

Minimum Wage With Overhead?
Feb 25, 2013

I graduated last year from MTEC.  I've been working since November at a national company and am earning minimum wage of $8.00.  Many recommend that you earn a certificate--starting with the RMT and later the CMT.  According to my research, each test costs about $200.  In addition, it is recommended that one keep up with the field by attending conferences and the like occasionally, which also tends to cost some money.  Now, I can understand the "overhead" if being a ...

Even With Accurate ASR, Still Minimum Wage.
Mar 18, 2013

I had a couple of ASR reports that were stellar, being of the quality we were promised (of course, not from my usual accounts), and yet, the lph was still around minimum wage (hovering around 200). What's up with that!? The new statistics graphic shows the proof. Geez, they keep handing us more and more proof that earning a living wage doing ASR for MM is hopeless. Anyone doing at least 300 lph without having dictator standard reports? ...

Minimum Wage Boost
Jun 22, 2014

Did you know that minimum wage will be raised from $8.00 to $9.00 next month, at least in California? So I wonder what that means for Nuance. Does that mean that the minimum line per hour will now be mmore than the current minimum of 186 lines/hour to meet minimum wage without having the company pay MUP or make-up pay? Or does that mean that they will give employees a raise and leave required lines at minimum of 186 lines? I wonder. ...

Why We Should Be Making More Than Minimum Wage
May 09, 2015

Why the lengthy testing before being hired? Any 16-year-old with no work experience can be hired at Burger King, so why not as a medical transcriptionist? MINIMUM WAGE - IT'S TRUE ! HALLELUJAH !
Nov 28, 2011

I called my parents' lawyer; this post is RIGHT ON! MTSOs have used semantics to rip us off for the past decade.  They DO have to pay minimum wage !  We do NOT work "production", as MTSO's claim. The term for compensation method regarding our work type is "tiered incentive"; there is an actual base hourly rate, which is what PTO 'per hour' time is designated and paid out at (in my case $12.00, almost $4.00 more than minimum wage in my state), and anything over ...
