IC Job Vs. Employee - CMT/QA for 30+ years

Posted: Jul 13th, 2016 - 6:54 pm In Reply to: you are wrong- not arguing anymore - you are clueless.

As I understand from researching it, it appears that the company cannot ask you to do BOTH a schedule and a line count requirement because that does mean you are an employee. However, have you noticed that some of them are only asking for 1 of those 2 things lately and think they can get away with that and I can't find if that is legal. I think they can ask for you to work "within" a schedule and you should be able to negotiate? But, as the other person said, if you (stupidly?) sign the contract, you are required to do what is in it. Periodically, I have (as another person above suggested) been sending emails to some of these companies instead of applying and point-blank asking them how they constitute this job as an IC job versus an employee when they are asking for a schedule and line count requirement? Of them removed their ad the next day from mtjobs.com and nobody has ever answered my inquiries...of course. I do see some of their ads are more carefully worded now, but how do we know that they just don't say up front about the line count, but still ask for a schedule. Keep in mind, some of them need help during these schedules, so if you object to full-time, negotiate and tell them you would like to work certain days and/or hours and maybe that is what they really want and we don't really understand that possibility? It is worth a try. Hope this is helpful.
