do you really think lawsuit will help? - slave wages

Posted: May 15, 2012

I don't want to be negative but do you really think anything will change?  MQ got sued and that didn't exactly improve anything.  I think we got a discount on a medical reference book and a time clock.  I'd like to hear opinions on this.

dont think it will change either - time will tell

[ In Reply To ..]
Also involved in MQ suit, big joke. I agree that Transcend will implement a time clock (like the Q) and maybe will have to pay OT, so they just will hire more people and not have a need for OT. Maybe schedule lockout like the Q tried to do. Most likely will ship more work overseas where they dont complain, and any money obtained will pay for legal costs and the rest divided between whomever is involved in suit, probably 5.00! Same story, different courtroom.

Why hire more people? - I would think

[ In Reply To ..]
the outcome would be the opposite. If they have to pay people for sitting around waiting for work, they solve the problem by having only enough people to get the work done, not by having even more people sitting around. At least that's what I hope. Also wanted to say IMHO the issue isn't that the MT has to look things up. That's a natural and necessary part of doing our job. The issue is being told that time spent in research shouldn't count toward the hours of your shift.

I know the attorneys told me - mtmom

[ In Reply To ..]
That settling with AHDI software or discounts and things like that are unacceptable for them. They want a money settlement so people can be paid for work done, plus pre- and post-judgment interest. While the attorneys will get their cut (as they should since they are providing a service) the rest would be divvied up among the people in the suit.

For me, whether I get money or not is not the issue. This has to be stopped. It's about doing the right thing. If I get money, then bonus. But if things do change, even better.

I know MQ really didn't change anything, but they can be looked at again if they are doing anything illegal. These attorneys are more than ready to take on any company that is doing what Transcend is right now.

I think - we should

[ In Reply To ..]
think positively about it and believe it will change things for the better. We are getting some attention. I also think we should do more, but that's just me. I think we should all inform the MTSOs of what our new wage is (pick the cpl you would like) and alternatively, let's all quit. Speech wreck is a mess. How would they recover without us. If the Indians need several layers of QA to complete a job and sometimes those jobs slip through without QA, I think we would have some power in quitting or stopping work for an hour or two simulanteously.

There have been events around the world where groups stop for a moment of silence for peace. Why not stop work for a living wage. Or, PRAY, for a living wage NOW.

I think one other thing MTs should consider. - When this suit is done. sm

The company in question is not the only offender. There are so many little things in each company that, over time, add up to big things.

I have plenty of work. I make a decent living, but there is still wage theft going on at my company. They do not cross the line with OT, but we are not paid for much work that we do and over time, it adds up. Since I do not get paid to research and insert copies, should I just not do them; send to QA and tell them something needs inserting?

I am not in the same position to complain like many MTs, but it simply is not fair. That is why I applaud all efforts, one company at a time, to put a stop to these practices.

I think it would be wonderful if EVERY single MT on these boards, and any others we could reach, wrote grievance letters to the AHDI outlining the wage theft and shady practices that go on in so very, very many companies (in case they do not know). Ask them where have they been as far as promoting MT as a professional industry. Ask them are they even Americans. Ask them is their purpose to form these sweat shops. Ask them why an MT would want to go through the trouble and expense to become certified and be a member under the current conditions. Ask them what they can do to help improve this industry. Again, it may take much time just like a civil suit, but their name should be drug into this situation as a whole and know that MTs nationwide are looking for something positive from them.

I agree on your thoughts regarding AHDI - mtmom

Unfortunately, I tell people not to get into this field these companies want people to have training, but then they really want experience on top of training, so they spend the money for training but can't find a job, and then that doesn't matter anyway because the money they spent on schooling is completely unjustified when they find what they can (read can't) make doing transcription. Luckily, I'm one of the people who have no formal "training" and have proven time and again that it really isn't necessary and a complete waste of money.

I looked at the Occupational Outlook Handbook today. It says that growth in medical transcription will be slower than average, but it also said the pay was around $32,000/year. They must be talking about in-house transcribers, because making that kind of money with these MTSOs is almost impossible unless you are constantly "fingers to keyboard" literally, and then for well over eight hours per day.
Your message speaks for itself - sm

Skills and education (training) are important.
They are important, and I have both... - mtmom
[ In Reply To ..]
I had OTJ training for many years, plus my many years of transcription experience. I know people who have gone to school and done the training... and their pay is as crappy as mine was... and some can't even get into MT because they have no experience even though they have training.

No skills and no training seem to working out well for the people in India who keep taking our jobs, so where is that helping us here with all our training and skills, especially those that paid for it in "medical transcription school?" Who is it important to? Certainly not the MTSOs. What a joke.

AHDI - old MT

[ In Reply To ..]
I've posted replies and comments on the AHDI Facebook site in regards to some of the posts they have, but they just delete them. They don't care about us, it's all about making that money. Until someone actually listens regarding their scam nothing will change.

I really do not think things will change that much - for any MT

[ In Reply To ..]
The Q lawsuit was huge and the biggest change to MTs was not the reference book and it was not a time clock. It was the restructuring of the definition of what constitutes a line. The Q lawsuit was the platform for the VBC line (visible black line), because it was not just about MTs, it was about overbilling clients by the millions.

So now the ones in this lawsuit think it what Transcend has been doing, but who do you think the top managers there play with? Think the Q.

Now Nuance owns Transcend, so who do you think that Q and T managers play with? Whose pockets are deeper? Q or N? think globally.

No I do not believe this is the start of something helpful for medical transcriptionists. I think this will further decrease the number of employee jobs and will force many to lose benefits by changing to independent contractor status.

Why is the only previous lawsuit - anon

[ In Reply To ..]
mentioned the one about the "Q"? I think they "paid their way" out of that one, just as so many companies/people pay their way out of lawsuits and court cases. There was another lawsuit a few years back concerning the same thing...not paying OT and asking to fudge on their time sheets/cards to reflect that. The company lost and had to pay the back OT wages, etc. There were not as many involved in the suit though and it was kept fairly quiet, but their initials was KS. check that one out. They had to pay. I am all for this current lawsuit and there are many issues here, not just the pay issue. I think it will change things for the better for the overall MTs. The MTSOs may change how they do things, and some of them may not be for the better for the MT, but I think they will now think twice about attempting to rip us off. At least that is what I am hoping. I commend the "grand 13" for their attempts. They are trying to do us all a service, not just themselves. That's much more than a lot of us have attempted! yay for them!

As an IC, I think I benefit more than I ever did as an employee - mtmom

This will only cause more rules to be put in place and the MTs will suffer more. Bad idea caused by bad MTs.

Agreed, but.... - Boosted Mom

[ In Reply To ..]
Aren't we already suffering, huh? Pay cut by 50% or more, treated like we work in a sweatshop? Why do you even think all this is happening? I've always said the OT issue is a catch-22; fight for it and you lose the ability to work off the clock; let it go and they just keep taking advantage of you. Will you be happy when everyone is making 2 or 3 cpl as the industry standard? We all helped to get us to where we are today, now some brave people who have had enough are trying to help make it right. (Of course this is just MY opinion.)

Brave? - Huh?

[ In Reply To ..]
Filing a lawsuit because your job sucks isn't brave, you're just ticked off. Please don't speak for me, I'm not ticked off, taken advantage of and I'm not suffering. Next, you people will be writing a theme song "first there was the speech machine but next came the Brave 13" or some crap.....gag!
just ticked off? - wiseoldwoman
[ In Reply To ..]
Just ticked off is when I stub my toe on the way to answer a ringing phone. Just ticked off is when I realize I've locked myself out of my apartment. I didn't join this suit because I was "just ticked off." I joined it because the law is being broken and that has to stop. I did refuse to break the law and falsify my timecard, but I'm not the only who had access to it and someone else did change it. Yes, I did leave Transcend. Do not make the statement that we're doing this because we're "just ticked off." NOTHING could be further from the truth.

If you don't wish to hear anything further about the lawsuit, please stop reading now. For those of you still here, it is my understanding that Nuance has used the same tactics as Transcend -- asking you to alter your time cards, reviewing your QA on your own time, "hands-only on the keyboard," etc. If this is the case, PLEASE contact the attorneys that are assisting the 'Grand 13.'  You have a case as well and do NOT let this opportunity pass by to make your statement loud ...

Transcend Lawsuit
May 28, 2014

Fighting Nuance would be just the same as the current Transcend Lawsuit. For those who are not involved, the latest news did not look good. They are trying to get it thrown out on the basis that because we are independent contractors kind of, the situations vary greatly and we should not be allowed to file as one unit. The attorneys for Transcend feel each MLS should file separately. Well, since we make slave wages, who the hell could ever afford an attorney? So, they have found every way p ...
