Anyone who comes to this site regularly is well aware of this suit. This is nothing new, although I personally would like to know the CURRENT status of it at this point.

for the poster who was asking about getting other companies involved, at the time this suit was begun, the attorney involved was willing to look at other companies, but you needed documentation, written documentation, of all that you stated against the company. Evidence, per se. Many at that time were jumping on the bandwagon. If you are still interested, contact the attorney involved and see what he has to say. Never hurts to try!

I am involved as part of this class action. It is still very fluid and will take a fairly long time to complete, but this is the latest information as of 03/19/2013. :)

I know you have to be very careful about what you say (lawyers frown on clients with big mouths) but it would be great if you could keep as posted as to the basic details of what happens as this case progresses, only with your attorney's approval of course.

So glad to have read about this. I am from a hospital that recently outsourced to M*Modal and right now I'm realizing that they are planning on not paying us for time in between reports, which is a federal law. They have a 15-minute rule where you are to file a "no work" ticket if you have no work for 15 minutes. But in the meantime, we have numerous times (totaling hours in a day) where there are no reports for less than 15 minutes and it looks like they simply don't pay their employees anything for this time. This would seem to clearly fall under the "on-call" rule and require payment. Of course, I have been speaking loudly for many years since joining this profession about the lack of respect given to MTs and the amount of knowledge needed to do the job, the QA ridiculousness (placing blame on the MT rather than on the MD who dictates), making benefits contingent upon meeting quotas, etc. I avoided these type of companies during my career, but now have come face-to-face with it as an employee of a hospital who outsourced. What do I (or many of you) have to lose when you don't even make enough in a month to pay the rent/mortgage let alone any bills? I have a situation where the manager has 3-4x the number of people needed to manage an account working, and thus, nobody has enough work to fill 8 hours (more like 4 if you are lucky). This suit needs to be widespread amongst all the companies. If these national firms weren't so busy undercutting their competitors with quotes and asked for fair compensation, perhaps they could afford to pay their employees properly.

on 5/28/13, I received papers asking whether I wanted to join the lawsuit or not. I had completely forgot about it until then. It is definitely a long process.
