I have been reading the daily posts for weeks now of MTs applying for jobs with MTSOs, large and small, leaving their sometimes current positions to go with a company who advertise they have new accounts, always steady work, never have to worry about NJA. Then, the MTs join these companies/service owners and within a day/sometimes hours, they have now fallen into the category of another day without work/waiting for work, etc. I just don't understand this.

I would think this would be a blatant lie to the MTs that could be taken to the Department of Labor, if not in their respective states, then the USDOL. Couldn't those MTs who responded to those ads, tested, recruited by those companies, etc. find the copy of the ad they saw on the website/s stating "always work, don't worry, yadda, yadda, yadda" and bring it to the attention of the DOL to get these companies in trouble for fraud of some kind? I would copy and paste every type of ad that these companies put out there into a personal folder on my computer if I applied to them, then, if I lost my job or had to leave to support my family because of "no work" or lack of work" after I was sort of promised thru that ad, that would be some sort of proof that the company faulted on their promise. They advertised something that was not true so to speak.

I feel for every MT who thought they were moving on to "greener pastures" only to be possibly in the same situation as before they left their previous employment. It is appalling to me that these companies can get away with this type of thing, and if it is the MT company recruiters that are doing this "stretching the truth" to gain additional MTs because it will put money in their pockets (recruiters=commissions) for the number they hire, then they should all be fired and the company brought up on damages.

You know, maybe class action might be the only way to go, because numbers speak!. Again, must my thinking...I may be way off base, but thought I should at least put it out there!!! Thanks for your time.

At that point, you would be laid off immediately for sure. There is no law against this. You would collect 50% of the measley money we are now making. The MTSOs know you can not survive on that and will get a job in short order. Some even collect partial UE while still employed.

What I would ask the MTSOs is how do you expect any MT to take their employment commitment to you seriously with this kind of workflow?

I would only pursue the above if you had to leave your job or were laid off because of it. I know different states have different laws. But if you took the job because they told you in the ad, you would not have to sit around and wait for work because they have plenty, and then you are sitting with no work...to me something is awry in that situation.

guarantee you work. Any amount of work depends on what they receive from the client, which they cannot control. Where I work we have plenty 95% of the time, but there are slow times where we struggle to make the minimum through no fault of the MTSO. If there is no work coming in, they cannot give it to the MTs to transcribe.

I am talking strictly about those companies who have recently just posted their ads to say, "come with us, where you will always have an abundance of work" without having to sit and wait for it. I am talking about those companies who just "happened to have signed new contracts" with new clients with so much work, they now have to hire for it. I have worked for MTSOs where times were lean due to holidays, equipment failure. etc and I understand that. But taking a look at those ads that talk about hiring for brand new accounts and then starting on those accounts only to have no work after a day or two. An MTSO would and should know how many MTs to hire and/or put on an account to accommodate the work flow and TAT they agreed upon, I would think.

The legalities basically come down to what is in your signed contract. Did they promise you endless work? Did it state that you would be on a new account with plenty of work? Did it state a limit on the time you would sit with NJA?

Personally, I think there should be legal clauses in all MT contracts about NJA. It is ridiculous for an MT to have to be available 12-16 hours a day for 8 hours of work. This clocking in and out for hours on end is ridiculous.

What about the companies who hire for those new accounts with "plenty of work." Of course, they do not tell you that it takes time, but those accounts will also go on VR as soon as they can accomplish it.

We have to accept the fact that this is what the industry is coming to. I don't care if you have been on the same account for 10+ years, nothing is permanent and there are no guarantees in this business. Some MTs can deal with that reality and plan accordingly. Personally, I am fed up with it and looking to get out.

I am speaking more about an employee relationship rather than an IC status. I was never in an IC status position, only employee, so never really signed any contracts for work. But if a company is advertising for employee status with all the "mumbo/jumbo", plenty of work, new great accounts, straight typing, etc and then you sit, still to me that is blatant lying. And as far as suing them, yes that would be a difficult feat but if those companies were penalized in a monetary fashion for what I would term unfair business practices, if enough of it happened, then maybe it would stop or at least lessened. I don't want to appear to have " pie in the sky" attitude, but enough is enough. I was employed on the same account for 9+ years with an MTSO and all of a sudden, the account went to VR without even so much as a "heads up" the day after I signed off. So I perfectly understand there is no quarantee in this business. For me, this came too early, I had 3 years until early retirement, so now to figure out where to go, what to do, do I still plan on retirement is the reality I am addressing now.

Do You Talk Out Loud To Your Dictators

I do.  My faithful dog who sits beside me all day must think I am talking to him, but sometimes when they say the most idiotic things I just feel compelled to respond out loud.  It does make me feel better.  On the flipside of that, I wonder if the dictators are thinking to themselves while dictating that they sure hope I don't leave any blanks so they have to fill them in. This doctor not only mumbles the name, but mumbles the spelling of the name.  I try every which way to spell what I hear, but I get that "no matching results found for the chosen criteria" ALONG WITH THAT *$#$ DING.  Its not enough to get that message of not finding the patient, but to hear that ding is driving me crazy....especially with report after report of this same name mumbling man... ...

Hello everyone, I have downloaded .wav files and tried to play them in Express Scribe and also in Transcription Buddy.  They both play great when first pressing the foot pedal.  But when I let up on the pedal, there is a VERY loud buzz that won't go away until I delete the file, and not even after I exit the software.   Each successive time I press and release the foot pedal, the quality of the buzzing changes - loud, soft, different tones - but it never goes away.  ...

How To Turn Off The Annoying Loud "ding Sound"at End Of Dictation/spell Check.

I thought there was a way to make that annoying ding sound at the end of the dictation when spell check is complete to sound softer.  I have Windows XP.  I keep looking in the control panel but it does not seem familiar to me as to the way I used to do it.  In some reports if the dictator talks low and then when you reach the end it blasts out my eardrum.  TIA. ...
