Has anyone working as an IC been required to obtain a business license or become an LLC to continue IC status? The company I IC with has been acquired by a new mgt company and they are requiring all IC to do this.

will come back and say they treated you as an employee. Also, they will not be responsible for you if you make an error. You will have to carry your own insurance.

Yes, this happened to me. I live in FL and FL does not offer a license for MT, so I told the gentleman I subcontracted for that I was not able to obtain one. But I had to give him something, so I ended up just making up a name for my business, I applied for a DBA (you can find out how to do that on the internet, it only cost maybe $35, don't remember) and I made up some biz cards and a flyer. I faxed everything to him and he kept it on file in case he got audited (that's what he needed it for).

What you will need to do is contact your city and state departments (I would start with the city department) and find out if they give out licenses for MTs. You can get their phone numbers off the internet. But if you live in FL, don't waste your time trying to check it out, as I already did that and it took hours upon hours.

You could also apply for an LLC which is what I was going to do as I was going to lose my job if I did not show the gentleman I IC'd for something showing I own my own business. But it is costly and in my case it wasn't really necessary because as I said, a DBA, biz card and a flyer sufficed.

Ok, so you live in FL like me. So don't bother trying to contact the State of FL cause they don't have a biz license for MT, like I said before. At this point, just google "city of (wherever you live)" and also "county of (wherever you live)" to get their phone number and give them a call and see what they say. It may be the same in all of FL that no city or county offers one. If they don't give out licenses for MT and you want to apply for a DBA as a last resort, we can switch to emailing each other and I will help you do that, as I still have my records on how I did that a few years ago. I can also tell you how I made up my biz card and flyer, it was easy.

i know transform is forcing us to prove our business status. PITA.

But when a company has both employees and contractors, they have to be able to differentiate what makes one different than the other.

I just started working as an IC for the 1st time. I talked to my accountant and she very strongly encouraged me to become a business to protect myself, my personal assets, and my joint assets with my husband. She said she has seen so many frivolous lawsuits, and if I make a mistake in a report I could be sued. She said even if I did nothing wrong, lawyer fees could be huge to defend myself if someone sues me. Being a business protects me from that -- if I get sued, I can dissolve the business and they won't have anyone to go after. It only took 1 day to get the LLC registered. Next I applied for a city license, which is required where I live. It seems worth it to me, but the company I am now transcribing for felt it was totally unnecessary. I guess it is an individual decision, but the accountant said if I'm filling out a Schedule C on income tax, that means I AM a business and I should do it correctly.

My state and local government does not require it and I'm not doing it! I can't afford it. By forming an LLC, we will most likely have to take out business liability insurance, which is costly in our income brackets. Also, we're now subject to the terms of the companies contracts and not our contracts with the company. We are not paid for the time we "monitor" systems for work and none comes in and we're not compensated for our time in web conferences and reading 80 e-mails each morning over petty things that don't apply to our jobs. We have to "invoice" what they tell us to invoice and not give these companies a true invoice of our time and production. Now, if we're required to form LLCs, the tax man will take even a bigger chunk of our pennies away since we're not filing as individuals on a Schedule C with our 1099s any longer. What happened to taking our business associate contracts and leaving it with that?

My PC Shorthand license expires 4/5, which is today.  I took that to mean I could renew today for my yearly license.  I was wrong.  Logged on to work today and see that PC Shorthand is expired.  Desperately trying to get hold of tech support at PC Shorthand.  In the meantime, anyone who uses PC Shorthand, can you answer my question?  If I go ahead and order a "new" license (instead of waiting on tech support to renew my old license), will I lose all of my expanders ...
