Independent Contract Status - Roo

Posted: Jan 27, 2015

Hi there.  I am searching for MT work again.  I have always worked under employee status and would like any advice/input, pros/cons about working under independent contractor experience.  Thanks so much!!!!!Wink

My opinion, IC for me is pointless. The company I am with still requires an exact schedule, make up hours, exact line counts and request/permission for any time off whatsoever. Being an employee for me was the same, only I didn't have to worry about taxes. Sorry I changed to IC and changed companies to be honest.

I usually go IC for the simple fact that I have found employee status more restricting with more demands/expectation. The last 2 companies I have worked for, smaller outfits, didn't expect me to have exact line counts. One wanted a schedule, which really they are not supposed to as IC. The other one wanted a schedule but I don't really seem to have to stick to it. If I was an employee I have found they make more demands and expect more; however, as IC I always have to tell them when I want off and if they have several others off at that time they can decline me So I stay IC, but it depends what company you are workin for. Last company as IC wanted more, and did a lot of auditing, grading, pulling my work at random, grading major, minor, critical erros about like Nuance does. Hated it.

my experience IC vs employee - MTMT

In my experience, I haven't seen much difference in scheduling between the two. I suppose some companies are more strict than others about scheduling. But I basically get up and start working right away, take a long lunch for nap time (they know this; I told them I would rather take a break and be sharp than working half asleep and so far all of my account managers are quite happy with this) and come back to work refreshed.

Financially, I prefer working as an employee. I get benefits and paid vacation. When you are an IC, you don't get paid when you take a day off. As an IC, my taxes were higher and I had to make sure I set aside money every pay so that when taxes were due I had the money.

Some people talk about being able to deduct expenses as an IC, but you can also do that as an employee. I take the same deductions either way.

Another thing I'd like to say about benefits. When I was an IC, I purchased my own health insurance. Then when I got an employee job, I decided to keep my own insurance. That way, I don't have to worry about the coverage and pricing I am stuck with that the company has chosen. Also, I don't have to stay in a job I don't like just because I need the insurance.

So, my preference is employee status. If you want to be more flexible in your hours, you might want to look at IC, but like I said before, I've never had a problem at the companies I've worked for. They know they can count on me to pitch in evenings & weekends if needed, I keep my work in TAT, and so they are happy to work with me. Also, keep in mind that even IC folks are usually stuck working a mandatory weekend day, so really, how flexible is your schedule after all?

Either way, I hope you find something that you enjoy and that pays your bills. Good luck!

Hi there. I appreciate the input. Thank you, everyone!

I worked for one of the big offshore companies - who monitored keyboard time

I was an employee but when I quit, I specifically looked for an IC job for more flexibility. Unfortunately, many companies advertise IC but ignore IRS guidelines and are really looking for employees (strict schedules, etc.) It took me a couple of months to find a 'true' IC position. I'm so glad I made the switch, even though I miss paid PTO and insurance benefits. It is much less stressful, I enjoy being an MT again, I choose my own 'schedule' and it's flexible (weekday afternoons/evenings; usually start between 1 and 4:30; line count varies according to workload/dinner plans, etc.), and I have never been denied time off.

Sample Contract For Employee Status Paid Per Line
Dec 15, 2012

The company I transcribe for has agreed to pay me per character line now instead of hourly rate, which is much more productive for me!   Question being, do I submit my line count to them and how do they deduct my taxes still???  Where could I find a company contract for them so that we both understand that I'm still their employee but paid cpl and a flat rate when doing office tasks once in a while?  Thank you for any samples/help. ...

Independent Contractor Versus Employee Status
Jan 16, 2011

Can anyone tell me if there are any advantages to being an independent contractor versus an employee?  I'm worried about being able to set aside taxes if they are not taken out automatically -- I work because I need the money and would prefer to not have to "bank it" for taxes later.  Seems like it is getting harder to find employee status jobs thay are not voice recognition / editing positions.  ...

Independent Contractor - Must Have Flexible Schedule To Qualify For IC Status
Mar 11, 2010

I am thinking about pursuing a job as an independent contractor as I am retired and want something to do more than the money (retired hospital transcriptionist). It is my understanding that an IC must have flexible schedule to qualify for IC status, yet the job ads specify second and third shift as well as weekend days. Can they do this? I know the government is cracking down on ICs to make sure they are truly ICs (we all know the transcription companies will do everything to preserve their bo ...

Independent Contractor Means "independent" Contractor - Sm
Oct 22, 2014

I am so tired of these companies hiring for an IC position and then when you are not at your keyboard johnny on the spot at 11 a.m. every day to start your day and sometimes start at 12 p.m. or 12:30 p.m., they are calling your cell, sending threatening E-mails.  They never stipulated in their contract that if you say, per se, you are going to work 11 a.m. to 7 p.m. and you start a little later, say 12 p.m. and work until the work is completed still getting getting the work completed well w ...

MDI Contract
Mar 15, 2010

I was looking through papers this morning and happened upon the contract MDI had us sign last January as independent contractors, but to be treated as statutory employees for FICA.  I didn't see anywhere where it stated an end date, and it did state that the contract was transferrable to any entity that might acquire MDI, if I read and understood it correctly.  Does that mean that Transcend was then bound by that same contract?  I am just wondering, since our line rate w ...

Contract Abuse?
Jun 26, 2010

Hi,   I have a big dilemma and I need help. I have been working for the same company for 6 years now. At first I worked for a bunch of doctors and a hospital and then quit the other docs and the hospital because one of my doctors said that he did not like to share and that he wanted me to work only for him. I did not know that was illegal to do until recently being that MTs are contractors. So I have been working for this one doctor and all the nurses and interns in the office for about 5 ...

Question About IC Contract
Aug 31, 2011

I have never worked as an IC before, only as an employee. I was offered a position by a company looking for an IC, and they have an IC contract that they send you and want you to sign. Is it common for an IC contract to contain the clause that you must provide 14 days' notice if you are resigning and that if you provide less than 7 days' notice they have the right to withold 50% of the monies owed to you? I can completely understand that they want adequate notice (just like any employe ...

Nov 13, 2012

Can someone please help me. I am new to the company, I have not been here 90 days yet. my TSM is "gone" so I have a new one now and have not yet spoken with her. I am very concerned because I realized that my "contracted" rate of 4 and 9 cpl at 150 lph does NOT meet my state minimum wage, I rarely get straight typing to get the 9 cpl. I also am not meeting the 150 lph yet, even so that is only like 6$ an hour, that is horrible. I should have done my math beforehand. I didn't think they coul ...

Question About 2 Clauses In IC Contract

IC Contract After A Month Of Work

IC Contract Question - Is This The Norm??
Feb 17, 2013

What do you think of this? Is this a normal inclusion on a contract? Personally, I think this is a load of B.S. (P.S., they only pay 5.75 cents/per line to begin with, for straight transcription.) Any errors requiring extra processing (blanks/questions) or reprocessing (resends) created by the Subcontractor will incur a charge that will be billed to the Subcontractor by the Contractor. Charges will be made on a per-line basis of the entire (re)processed document with said line being 65 charact ...

Employment Contract With Nuance
Mar 16, 2013

I was offered a position at Nuance and was surprised to get the employment agreement that states I will be an "at-will" employee and that I must apply again in one year as the employment agreement is only for one year.  I was shocked.  I have never heard of this.  I am middle-aged and have never heard of "at-will" employment.  I have also never had to reapply with a company after 1 year.  Are all Nuance employees given this type of employment agreement?    Th ...

Anyone Get A Contract From MedScribe . . . Amazing!
May 09, 2013

I got a contract with this company and have never seen anything like it.  Their performance rating/expectations outline is the most condenscending, tryannical thing I have ever read.  I bet military rules are more lax than this company.  They give you a 12-hour window but then say you cannot leave your computer for more than 30 minutes 3 times a day.  Then even go on to explain you can't go to a party, grocery shopping, go to the gym, school event, social gathering, bake ...
