Wage not paid by Kathy Yip and Associates - Former IC employee

Kathy Yip has not paid me my last check for wages earned. No contact whatsoever. Refuses to answer calls or email messages. Where do I submit a labor claim in Florida or do you do it in the your home state?  Has anyone filed a claim for IC and received their wages? Reported her to BBB and see what happens there. Any other ideas to obtain your last check?

Stating that you will report her to the labor board, BBB, that you intend to post her name on sites such as this, and file in small claims court. State that you have no intentions on backing down, that you did the work and expect to be paid. And then don't stop. I would place an ad in her local newspaper also!

She said it's an IC position, so the Labor Board would have no jurisdiction unless you wanted to go through and have yourself declared an employee.

As an IC you have to go through the collections procedure, just like if you don't pay your light bill after you've used the service.

If you file, it has to be in her state, not your own.

Depending on the amount of money, I'd contact an attorney.

If you never collect, don't forget to write the entire amount off on your income taxes this year.

I would still get her on record with the labor board. This MTSO may have other MTs whom she classifies as employees. We need to make a record when MTSOs do these things. We need to protect each other.

just file the small claims court thing. I believe you can file in your state, but you need her address and such so she can be served with notice. It may cost you about $80 up front, but she has to repay those when she loses, and she will lose...although still no guarantee you will get your money. They will just file a judgment against her and then you have to stand in line, as I am sure there are others as well who have not been paid. If she files bankruptcy, you may be out of luck entirely depending on the amount, but it will still be on her credit report, which can do a lot of damage all by itself. good luck. these people need to be held accountable as much as any local employer would be. We may be "anonymous" on line, but we are real people in reality and deserve to be treated with so much more respect than we have been over the years. :-)

I will contact my labor board and file. I have talked to my attorney and will see about going through him to file with small claims court to get my payment. Thank you for the additional ideas.

worth a shot - plus it's then public record for anyone looking up the company for any reason - such as credit checks. Indicates shady lady all over the place.

File.

And BBB may not get the money but it speaks loud once again to all wanting to 'meet'n'great' Ms. Nip who are thinking of doing business with her.

Contact the Fraud Division of the Attorney General in your state and in the state in which she is located. Attach a copy of any contracts, bills, etc. I don't know how much she owes you, but it might be worth it to have an attorney write her a simple demand letter. Sometimes just seeing "Attorney at Law" on a letterhead will straighten people out. And yes, do go to the Labor Board. As to the BBB, it will be a nice warning to future clients about the character of this person, but the BBB offers you no legal remedy. Good luck.

I had the owner of another MT board go to bat for me. She got me almost all the wages that were due me. Hopefully, this helps.

I too an waiting payment from a MTSO in Florida - since April no less. The Florida Dept of Labor has been very helpful. GOOD LUCK!

she can help you get your money due. If she is unable to help then lawyer with demand letter, if that does not work then small claims court. If it was me I would follow it to the end on the principle of the matter alone. Good luck.

Yes, I contacted the moderator and gave her my information. I do have an attorney to send her a demand letter for payment if I need to. I have contacted BBB and will be contacting the labor board in Florida and in my area. She usually pays, but for some reason the last check she wants to drag it out and have no contact whatsoever.

This is some of the worst audio I have EVER heard in my 30+ years in this business.  I have sent emails and IM's but "apparently, the problem is on my end, becuase everything is as clear as a bell."   NOT!  Short, clippy, clinic notes, and QA pickier than all get out.  I notated a tempate where I thought there was an incorrect spelling and was called on the carpet was that -- actually QA was wrong.  With the amount of lines they expect as an IC per day, it is ridiculous and of course, ...

Does anybody know anything about TransAm Associates in Valrico, FL.  I've heard many different things, good and bad, but have found out after working for them that they simply do not have enough work to go around.  Sometimes I will have a lot of work and actually make a good buck, but then the rest of the month (yep paid once a month) - is so bleak and in "feast or famine" mode, may only see two to four jobs per day, thus negating all the earnings I made earlier in the month!  ...

Im so confused, I keep reading on different forums on line how hard it can be to break into medical coding. Does having an AA degree help?  Is that a plus?  I see some on line colleges that are accredited offer AA degrees, AABS degrees, etc.....whats the difference? Is it better for a newbie to go straight to AHIMA and take their cluster of courses or take an on line billing class through one of the on-line universities, then go test at AHIMA and AAPC?  ...
