How do you get someone to pay you that has not paid you?  Getting really aggravated about this and don't know what to do.  I have been given every excuse in the book!

Municipal agencies do not and should not serve as collection agencies for private matters. That is why you should have an attorney.

they will tell you it is a civil matter and to file in court. Please do not bother public safety with this issue. I'm just speaking as the wife of a police officer.

are an IC, send a final demand letter return receipt requested with the total amount due and expected receive by date. If there is no reply or no payment forthcoming you can file a claim in small claims court. The paperwork is fairly easy and the court will help you. Sometimes being served with the suit papers might "remind" them to pay up. If not, you'll probably end up with a judgment and then need to go forward attempting to collect.

If you're an employee, simply notify your local labor board.

I'd start with the certified letter. That may get things rolling.

Either file with your State Labor Board, or else - in Small Claims Court. (sm)

In another instance, I showed up unannounced, in person, with my hand out. Embarrassed the you-know-what out of them, as they had clients there, and they paid me on the spot. Long drive to get there, but it was worth it to see the looks on their faces. Like they'd seen a ghost.

It was tempting not to shout, "BOO!"

I was stiffed on $3,300 from a company I worked for - one month's wages. I sued in small claims, won by default because they didn't show up, filed a writ of execution (that's what it's called in California - check your state) and had it served at the company she contracted with. Best way to get your money. The only way is a wage garnishment if they have no assets. You can also file a discovery in small claims and they MUST show up to court and give the judge their bank account info and other stuff.

You can't give up, people. I just had to do this again today for a company I worked for last year. I am in NV now and they are in MI. I don't have to personally appear in court. I have to have my statement of facts notarized, pay the filing and service fees, and it's all done that way.

Amazed how often this is listed on this board of no pay, First of all, 3 months is ridiculous for sure. Sit down and compose the problems, addresses, company name, email address, phone, fax and include your proof you have made 3 or more contacts for pay, enclose copy of invoices, atempts to collects etc. Then make copies and send to each below.
The small claims you need the same paper work, buy you fill out forms, submit to the superior court and they give you a court date, you notify them (serving papers) 10 days prior. Google gives all the instruntions, it is easy, but scary when I did it, as I was not familiar. You can email me if you want.


I would try the (no cost, other than filing court fee ($39 in california)
and tell them your plans, list #1, #2, #3 routes you intend to use. They may just pay up, but I doubt it, would send to the attorney general office (they investigate fraud) and the State labor board anyway even if get money. This has happened tooo many times, they are a scam, work but no pay. There is a limit on what you can collect (money limit) according to your state (so 3 months pay is adding up quickly for small claims court.

SMALL CLAIMS COURT. Get your money
You CAN go to small claims court, this is a superior court, look in your yellow pages under county/state/federal section. There is a time frame to file a claim, so check it out. You can go google.com enter small claims it will bring up instructions of how to proceed, can print out the (3) forms, fill in and here in California can mail them in, costs $39 filing fee, you mail in check, they mail back a court date. No attorney fees. You are in court with all your "proof" of whatever is owed. You need to keep emails, letters, contract, whatever etc 3 attempts have to show you made to them for request to be paid. If they are not in the same state ask the court clear how to handle, as they do need to be presented/served with court dates 10 days ahead. Presented with fact of court date/action, they may just skip this action and pay up. If they do not appear, you win. If you win and they do not pay, they can have lien put on any property they have, their checks can be garnished and bank account can be garnished. Yep true. It all sounds complicated, but in retrospect, it really was easy, I was just scared/anxious as never did this stuff before. I would not hesitate, it was simple (though this was not for wages for me) but still, you CAN do it all by yourself. They get away with it, as nobody takes action

Here is a link on instructions for filing a small claims court case. This is for California but you can google.com + your state +plus small claims filing instructions. Just click around and read. It sounds hard, but really easy. Needed to print out and fill in only 3 forms to fill out and mail in to the court to get a court date.

I've been working with my company for almost a year now and i'm wondering if I should start looking around at other compaines. I graduated from M-Tec last summer and got a job about a month later, they started me at 0.055 cpl, then in December bumped me up to 0.06 cpl. . . . we have to retype the entire VR job because it is 99% WRONG. It seems like it is getting worse instead of better.  The last week practically every job has every fifth word right but the rest is wrong.  At some point it quits being voice recognition and is pure transcription.  Any time we have to fix more than 10% of any job = straight typing.  And they wonder why we HATE VR?  It was nothing more than a ploy to get 50% of the MTs pay. ...

Detail.  Then click on a job number and when page comes up on job view pull down, select Count Log file.  THAT will show the job you are getting paid on.  It will show the multiplier etc.  Doesnt matter what the final line count is.  That may not be what you actually did anyway.  Final line count is the count they are paying you on, not necessarily the count you actually did. ...
