This looks like a class action suit. - This needs looking into.

I routinely work over 40 hours a week to get my minimum lines when there is lack of work and/or slow work coming in. It's not just KS and I wouldn't be surprised if other MTSOs are hit with lawsuits soon. Whether she wins this one or not and whether KS is guilty or not, I'm sure there are more to come.

My neighbor collects unemployment (going on 70 weeks) doing nothing and makes more than I do working 40-plus hours a week. What's wrong with this picture?

I am never out of work, and I do 300 lph, so I am fine, but we keep getting pushed to do extra. I end up putting in an average of 50-60 hours a week. Shouldn't I being paid overtime? Any legal eagles out there? My DH wants to know.

regional manager or someone who runs an account is not letting them know.

Go higher than your direct supervisor if you don't get an answer, and if nothing else, go to the owner or owners of the company. They most likely don't know you're working OT without being paid extra.
It depends on your state laws for home workers. - It is different by state.

We are paid piece work, so that is a gray area. MQ was actually cleared by the Labor Board investigation, and they chose to settle the lawsuit via AHDI.

right there is a good reason for a much higher piece rate for doing the work. Because the main reason most MTs are working unpaid overtime these days is because the work is grossly underpaid, such that it comes out to less than minimum wage.

They're paying us and evaluating us based on how things used to be when we did straight transcription, and had simpler software. I did more lines, and made more money, back when I was still working on a Selectric typewriter, than I do now on a PC with so-called "state-of-the-art" software.

I was a radiology lead when this person worked for KS, and she was paid OT. She told someone, after calling many, that this is her "ticket". Interesting.

So, they bought her a Christmas tree...nice, but I'm sure it doesn't make up for uncompensated overtime. I personally have worked lots of OT without compensation and I am continually asked on almost a daily basis to work more, to cover vacations, etc., with the manager asking knowing full well this would be overtime hours, but overtime is never offered.

I do not work for KS but my situation sounds the same as yours. I thought they had to pay OT for over 40 hours a week.

Whether they "offer" you OT or not, it's up to you whether you choose to work it. I will NOT work anything over 40 hours without OT pay. If they want me to work over 40 hours, they WILL pay me at OT rate by FEDERAL LAW. If they ask me to work, I ask them if it is OT???? It's YOUR fault if you don't ask them directly if it is OT and if you are getting OT pay for it. If you are over your 40 hours, they are mandated BY LAW to pay you OT pay. It's that plain and simple.

IC's do not get OT and some of us are "required" to work OT all the time. Mine is 7 days a week at 1100 lines per day mandatory. Unless you have an answer for that, as well.

Also, remember that no one really won the MQ lawsuit--they settled. We all have worked for MTSOs knowing we would not get overtime pay. There is a lot of blame to be levied on ourselves for agreeing to it. Can we legitimately cry "rape" now? I don't think so...

But KS has cleaned up their act now, so they will be a better company for it.

Every MQMT won...we are now paid for overtime (in dollars, not Christmas trees) when we work it, which for me is often because things have gotten so crappy with MTSOs in general that many, many competent MTs have thrown in the towel on medical transcription altogether.

The only thing that will force MTSOs to follow labor laws is a lawsuit. It makes NO DIFFERENCE what the plantiff is reported to have said if proof of wrong doing exists.

That was not the only lawsuit....there have been others. The one before that I was awarded approximately $300.

and the MTs didn't even get a kiss. I guess all of that sleeping AHDI did with MQ through the years (figuratively, not literally) paid off in a big way. But I believe in karma and MQ and AHDI both have a big debt to settle with the universe.....

How many of us went to the "free" training that AHDI was "awarding" us? Jeesh! We should have all signed up and overwhelmed AHDI. Ah well...that's life.

I liked working for MQ...they essentially left me alone and let me do my work. Now don't even ask me about Spheris and TransHealth...to put it nicely--not my cuppa tea.

If you're entitled to overtime and did not receive it, your "friend" is the Federal Department of Labor and your state's DOL. Even though you are no longer employed by this MTSO, you might still be eligible to pursue an unpaid-overtime claim depending on how long ago you worked at the company. Call your state's DOL for the facts.

guilty of not paying OT. I worked for them for about 6 months. I was asked to work OT almost every weekend and was never paid a penny more than my normal line rate.

I was new, didn't want to rock the boat and had pretty much already decided KS was not a place I wanted to end my career so I didn't say anything and just let it go.

I see where so people say they always got OT, but it wasn't like that across the board. If you work OT you should get it without having to ask for it.

You should inquire about it now since you are - no longer a KSer.

They can't threaten or get rid of you now. If entitled to overtime, maybe you can collect it now. I plan on doing the very same thing. I also wonder if they aren't charging the hospitals/clinics a higher rate for weekend work and only paying their MT's a flat everyday rate for evening, overnight and weekend work.

As long as KS continues to get away with this, they will continue to do so until stopped.

But I think it's a wise move on her part. In the times we're in right now, it's likely many on the jury could be going through a similar unpaid overtime problem with their employers, or know someone who is. I hope KS gets the book thrown at them, as this problem is rampant in medical transcription. I, too, am an MT who works many hours of unpaid OT every week, all in the name of "keeping up my line count", which I know, and they know, cannot be accomplished within a standard 8-hour shift. It's time for all MTSOs to try a new way of doing business: Honesty and fair wages for work done.

and QA dings me for one.  Unbelievable.  That's what it averages for 1400 lines a day full-time.  Even with 3 cups of coffee and an office chair seat belt, it's no easy feat.  Ninety-thousand keystrokes PER DAY.  That's not including the ADT, the Internet look-ups, etc.  Throw me a bone here, QA. How many keystrokes to you do, PERFECTLY?? ...

How is it? The trainer says it is one of the easiest platforms to learn on if you've never done it.
