Workmans Comp Insurance Necessary? - SeriousMT

So I am about to take on a second IC job in a few days.   Was just about to sign the contract agreement and as I was reading through it, I noticed that while it didn't expressly say I HAD to purchase workman's comp insurance, it did say that I was responsible for workmans comp.

Is this something anyone is familiar with?  Is it really necessary for me to purchase on my own if this is a part-time IC job and the company has a secure server with upload/download capabilities?  My pay is so miniscule that the thought of having to take out insurance on my own is pretty scary to me right now...We have liability insurance through our own private insurance company (my family) which is to cover us in case we get sued.  Would this be sufficient rather than taking out workmans comp?

WC doesn't cover any liability. It is there in case you get injured on the job and then subsequently file a claim. So your family's personal insurance with liability coverage is a different animal.

I suspect the company just inserted that as a "CYA" measure. It is entirely up to you whether or not you purchase any additional coverage to protect yourself in case you are injured on the job or suffer some physical problem (carpal tunnel syndrome, etc.) as a result of it. That could certainly take the form of a private long-term disability policy or contributing into the Workman's Compensation fund.

If you work another job that is employee status, you are covered by them - But it blurs the lines if also IC sm

Worker's Comp is insurance an employer pays to cover their workers against any injuries which occur while working. This can be an acute injury or an "occupational disease" injury. Occupational disease has to be proven that you received the condition directly from your occupation, eg - coal miners have respiratory issues, which are considered occupational diseases, a lot of factory workers have issues with upper and lower extremities, and back If the condition arises slowly, it's considered an occupational disease, and the employer's insurance is responsible for all costs of treatment, and the worker's pay while off work.

Transcriptionists can suffer numerous types of occupational diseases, eg diseases of the neck, wrists, hands, etc. If you are one who works for several different companies, it has to be determined which employer(s) are responsible for covering treatment, and that's who you file a claim against. If you are an IC part-time, they could decide it was YOUR IC job that caused the disease and YOU will be responsible for ALL treatment costs. Hope this helps.

Not sure why the company would require WC insurance. As an IC you are essentially the head of your own company and typically owners are excluded from any kind of WC policy.

The liability is another animal, as another poster said. There's general liability such as that you have on your home which will cover you if someone trips and falls or injures themselves somehow on your property. What some MT companies are trying to require is Errors & Omissions insurance which is very expensive (usually) and questionable as to whether you should be really required to carry it as an "IC" working for an MTSO.

This was exactly the information I needed. I am not planning to purchase my own workman's comp...hence, I would not hold the company responsible should I develop anything like carpal tunnel syndrome. LOL! What I was concerned about was whether I could be held liable by the company should someone infiltrate their system and gain access to records I had transcribed. My guess is no -- better go review my HIPAA notes...

I always considered myself an average transcriptionist.  On my platform I average about 150 LPH and very rarely do I go over 10% to QC and QA is usually in the 99.5% range.  Based on my last weeks information and using their charts, I will be getting about 2+ cpl more than I have in the past year on my straight production.  I guess I may be way luckier than the people posting here.  Maybe I am a better transcriptionist than I thought I was?  I figure if I only have 1 cra ...

Thanks in advance.  Has any California Medquist MT ever had carpal tunnel diagnosis and had the insurance company ask you to give them more information about the "nature" of your injury, as in they want an explanation if I think it is work injury, car accident, or other?  I hate to lie, but it is pretty obvious I have it from typing.  Also, if I said it is from work, they refuse to pay the neurologist who gave diagnosis.  I pay into Worker's Comp in California, it is ded ...

has anyone had no post audit reports for the week under the new comp plan?  this is my first week of coming across this problem - there were 2 post audits during the week in FIESA, but they were for reports the previous week and I received no PA scores for the week - I'm assuming this puts me in the 0.08000 category for 0%-99% whereas normally getting 100% and this is making a HUGE diff in hourly rate - there needs to be something in place where we have to receive at least 1 PA sc ...

I had 100% from 1/9 through 1/15, 3 jobs edited.  Today a job is reviewed that was transcribed on 1/15 but edited on 1/17 with an age error in it.  Where does that fall.  It does not show up for last week, but shows up on 1/17 but was typed the week prior?  Confused. Thanks for help. ...

This means 65% will see decrease and/or paid minimum wage. New Comp Plan Not "punitive?"

I haven't had a single report audited until today...I had 5 reports audited, all 100%. The very next one knocked my score down to 98.9 (the report was only 9 lines). I'm just wondering if they were going to audit until they found something to knock me down, or if that was indeed a random audit? Today is the last day of my work week and I will be unable to check FIESA until Sunday, so I'll be unable to request a reversal and just be screwed I guess.  Still not seeing the advan ...
