If a civil case goes to trial you can be compelled, usually, to pay if you lose. (Did OJ ever pay the Brown's and the Goldman's?)
When both parties in a civil case agree to settle, then it's whatever they settle on.
Kaiser Facts Straight: correct me if I'm wrong, but as I remember it... The settlement was that Medquist/Modal bought Benchmark licenses from AAMT for their MTs. So the MTs did get a little something out of the deal, but not much. It worked out that way because it's what the two parties agreed to.
