detailed HIPPA compliance protocol - ConfusedMT

My company is making all ICs draw up their own to detailed HIPAA compliance processes and security protocols, provide proof of HIPAA and insurance compliance and have a signed Business Associate Agreement in place. They are also requiring that we have more than 1 company that we work for, to be considered an IC. Has anyone ever done this before? Any suggestions on where to start for drawing up the HIPPA protocols, etc?

in order to do. We did not have to provide or draw up procedures, insurance compliance. I would be up the creek without a paddle if I were asked to do this, would not have any idea how to do.

to extremes, for fear of being sued themselves. The way I took the OPs post was that the employer is trying to protect themselves more than anything. Since the "new IC" status is now "business associate," and since the BA is "supposed to" be her own business, that "business" should also have standards for compliance to the HIPAA rules and regulations, which is the reason why they are asking for what the BAs business procedures are in order to be compliant with HIPAA. A "business" should also have "insurance" to protect themselves against a potential law suit if some transcriptionists error in reporting patient care leads to that patient's death. They are also asking that the BA work for more than one client, so as not to look like an "employee" for the MTSO they are currently working for. Some MTSO's have been in trouble in the past with the IRS for having a transcriptionist as an IC, and in reality were treated like an employee, but not taking out taxes, etc. The MTSO is covering their behinds, but perhaps carrying it a bit too far and putting this type of burden on the transcriptionist, because as an IC, they truly ARE in business for themselves, and should be HIPAA compliant, as well.

I dont mind getting the insurance, I totally understand that part of it. Its the other stuff that I am having a hard time getting accomplished. They are asking for so much stuff and I have no where to even begin to start to get it all and I only have 30 days to be compliant or my pay gets cut in half when I become an employee.

for most of 2013 that they had to be compliant by the end of the year. Now that it is November (already) they are in a rush to get it done, which is why you only have 30 days. I know that is no help to you at all, but they are pushing their problems onto your shoulders. Maybe, if they realize you are diligently working on it, they will give you a little leniency. After all, they should have started this in like June or something. I wish I could be of more help. good luck to you.

I mentioned it was not your fault...ok..now you know who I am, sort of, but I am just starting with a new service today and the owner mentioned having to have policies in place for HIPAA, as well. she is going to be sending me copies of "examples" for me to implement. once I receive those, I can share them with you, if that will help any? I can email you once received.

Has anyone on here ever been written up for not following schedule?  I know its important to follow but they out of the blue last summer called me up and said I had to change my schedule and I now have more evening hours.  I was already working on Sundays but anyway I used to work 2 hours in the eveings and would somehow like to get back to that instead of 4 hours.   CCm in my group sent out an email a short while ago stating if she found out people were not working schedule ...

Is this more strict? or is it the same?  Am I freaking out for nothing new? How can any company be compliant with HITECH/HIPPA when they send work overseas. Isn't that a HIPPA violation and should the patient be notified that their personal information, diagnoses, history, SS#, in some cases home address, DOB, etc, is sometimes mentioned in reports and overseas MTs have access to it?  How can any company be compliant, especially with HITECH be compliant with these new laws, regulations, etc, when the patient is not aware their information is accessed overseas ...
