Mandatory training without pay - Really? - Lucy

Posted: Jun 03, 2010

Just informed that I have to take MANDATORY HIPAA training without pay because I can take it "anytime on my OWN time!"  LOL!!!  The course is 45 minutes long!  It is not enough that we have to learn account specifics "on our own time", read the constant silly e-mails "on our own time", but now we have to do mandatory training "on our own time."  Oh, yeah - and we have to pass the class with a test at the end too!  I feel like I am in a volunteer job!   Hmmmm, I wonder if 9 to 5 office staff have to read their company e-mails and take mandatory classes and tests outside of work hours . . . ?

I worked in-house and the boss tried telling us we had to - Read work-related emails, etc., BEFORE our shift

[ In Reply To ..]
Yeah, I emailed her back and informed her that this was essentially telling us that, since we were doing it "before the start of our shift," that would mean without pay and our personal time, and I didn't think it was wise to put that into an email...After all, that would be *cough, cough* "illegal," and acted like I was helping her to cover her own backside.

About 10 minutes later, all of the MTs received a very convenient email saying that isn't QUITE what she meant, that we should read these at the start of our shifts before beginning to transcribe and, of course, we would be paid for it.

Yeah, SUREEEEEE that's what she meant. *eye roll*

These buffoons, always trying to get something free out of us, really irritate me, lol!

I don't know if that would work in your case (probably not since it's an MTSO), but it did feel good getting that one little victory from the supervisor I had. Too bad we can't challenge them and win more.

Where I work, training is paid at our base hourly - k

rate we are paid for vacation -- so I would get $13 an hour. They usually tell us that we will be paid for xx minutes, 45 minutes, 30 minutes, 1 hour, etc. Just like overtime, it is illegal to require "work" off the clock.

I agree! - Lucy

I put in a lot of time "off the clock" already! I think 45 minutes and taking a test is a bit over the top, especially since they say it is mandatory. The e-mail made it sound like I should be totally grateful since I could do it at my convenience, but before June 15th! I wonder if the offshores have to do it on their own time too - very interesting!

E-mail on-site - Anonymous

I work on site and always get to the office a few minutes before the start of my shift to read my e-mail on my own time and get organized for the day, otherwise it cuts into my production. I never thought about it being illegal, it just gives me a few minutes to get my head together first thing in the morning.

Totally different though if you're doing it voluntarily - I did the same thing

[ In Reply To ..]
Yeah, I do that too, for my own peace of mind and by choice. Pour some coffee, glance through and sort emails, look at the cue to see how much is dictated and ready to go while I have my coffee. But that's just to let me ease into the pace of the day, like what you do. But when they tell us we have to do it on our own time, that's a horse of an entirely different color. They tried convincing us that taking the HIPAA tests, OSHA tests, ad nauseaum, on our own time was to our benefit too, but we all know that's just their special little way of trying to get around paying us for what adds up to a considerable amount of time at the end of the year, if you think about it. Each one of those tests can take up to an hour by themselves, then factor in the time if everyday you're forced to do your emails, scheduling, etc., on your own time. Multiply that by number of employees and that's a serious chunk of cash they save themselves at the end of the year!

Mandatory Training w/o pay - Rachel

I just received the same email from my boss about this. I do believe by federal law anything mandatory (training, meetings, etc) MUST be paid by the employer. I am actually going to email my boss about that now as my time is valuable and I can't just be expected to do things (mandatory) without pay. Wonder if we work for the same company?! lol

Same email. This is the one that broke the camels back. I just took a paid Hipaa class 2 months ago for a different employer and have a certificate. Not good enough for them! Just lost another employee here. Can't print what my husband said.......

Wonder if anyone else in the company is going to question it. Sorry to hear that you may leave over this, but I don't blame you. There are a lot of things about this company that bother me, but with 5 kids, staying home is the only option I have and some money is better than no money. I can't believe the small amount of pay we get for edit lines either! I am lucky to clear $10 and hour. I work for a private psychologist and I get paid $3 per page (which amounts to about $20 an hour). Wish she did more than part-time work or I'd do her work only. :)

This class even included the new HITECH act! An I am/was an employee, so it should be paid per DOL.

You should definitely be given credit for your HIPAA class and should not have to take it a second time. The information does not change that quickly and the rules and guidelines are the same everywhere you go. My employers have always honored classes that I've taken elsewhere. We've always gotten paid for mandatory training or department meetings, anything else we do like college classes during working hours are on our own and we are expected to make up that time. Sorry you're going through this, it would make me angry too.

Training without pay nothing new - sm

Up until a few months ago, I kept a second job at a hospital in a clinical field on a p.r.n. scheduled. We had to have all of our certifications up to date for our department, and we were not paid to get them done. Ex: Most departments require CPR. Some with ACLS and PALS. They will not pay you for the time spent doing these. They will let you take them for free in training and education, but you do not clock in. I would have to drive to a different site to get TB testing, mask fitting. This also was an unpaid thing. This was for every job title.

You know, my sister-in-law is a teacher, and she is having to spend a lot of time for recertification this summer that she is having to pay for through a college, or she cannot teach. This kind of stuff happens in all fields. Just one of those things.

Thank you all I no longer feel like grinch!!! - Whatyagunnado

We used to get paid for time to read company e-mails, training, etc., then things changed!! Oh well.

TT Mandatory Training

In my state, they are required by law to pay.  I called the labor board to verify.  By law, they have to pay if you are a non-exempt employee.  I can't file a complaint until the training is completed, but I can do it online the same day as I complete the training.  They (labor board) also advised that I keep emails and attach them to the complaint.  Unfortunately, it could take up to a year to get the money - my state is sloooow in resolving issues. Even still, my ...

Mandatory Fluency Training
Aug 26, 2013

In this day and age why does there have to be a set time of training??? I'm sorry i'm just frustrated.  I don't want to go into detail should it give away my identity but there is just no time in my day TWO DAYS IN A FREAKING ROW for up to 5 hours of training.  I have worked for this company before in different capaciites and have never had to have 10 hours of training over a 2 day span.  Unbelieveable.  /rant    Thanks for letting me vent.  ...

Mandatory HIPAA Training UNPAID
Jun 04, 2010

So I read the below post about the email circulating among some employers (including mine) about this mandatory class and test for HIPAA. This is an excerpt from what I received today in my inbox:  I am getting some questions about the mandatory HIPAA class being unpaid.  Let me clarify why this is the case.  Taking the class is mandatory, but unpaid because it is a legal requirement and can be taken at your own pace, on your own time.  We are actually helping you to protect ...

Is EMR Mandatory?
Apr 16, 2012

Perhaps I should know the answer but I do not.  What is the deal with the move to EMR?  Is it government mandated?  I just picked up a good side job transcribing for a cardiology group in my community and it's projected to last only until they go to EMR..the move isn't happening too quickly...are there penalties if they don't move to EMR?  Who is driving this? ...

Anybody enjoying the mandatory overtime.  Yea funny how we are on mandatory overtime and then get an email that states that if you run out of work, you are required to email them and flex your time and can only make it up after 5 p.m.  So again, you are required to check for your work throughout the day and if there is no work, sorry for your luck and if you want to be "lucky" enough to be employed w/ Nuance, you will then have to sign in and work on your off shift to make up your hour ...

Mandatory Meetings - DSG
Apr 22, 2010

How can a company order you to attend mandatory conference calls and mandatory HIPAA training and mandatory platform training sessions and not pay you for your time?  Every time they send an e-mail for something such as this, they refuse to pay, even for an hour of time.  They tell you these meetings and conference calls are a bonus for you, and that they are saving you money by you not having to pay for them someday (do I look like I just fell off of the turnip truck?).  They mus ...

Looks Like Mandatory CMT Credentials Soon.
Aug 02, 2010

Just like the post below stated, House of Delgates known as (HOD) from AHDI is wanting everyone to ensure patient safety and the integrity of patient records, all persons involved in creating, editing, organizing, or transmitting protected health information should be formally trained and hold credentials relevant to those duties.  To that end, AHDI should move forward with the support of its leadership in actively advocating for mandatory credentialing by whatever means that can be accompl ...

Mandatory Weekends....why?
Apr 09, 2011

Why do MTSOs require weekend coverage for every one of their accounts? I have 2 and have work up the yin yang during the week but come Saturday, I'm watching paint dry. My MTSO requires 1 weekend day, at least 4 hours. I changed my weekend shift TWICE to work during the "busy" dictation times and I'm still NJA. Now that it's getting nicer outside, I've got plans and wanna have a life again. The higher ups get off every weekend, why can't we, or at least rotate? I do ...

Is OT Mandatory At Webmedx?
Oct 05, 2011

I am curious to know if all this overtime every week is mandatory or not.  MY AM asks for overtime on a daily basis and wants commitments for the week. I have been doing it, but am to the point where I just dont want to anymore, I have things in my life that I need to do or want to do instead of spending MY free time always working, working, working. Does anyone else feel this way too? I just dont want to get in trouble if I dont sign up and "commit" to the overtime every week. Thanks! ...

Mandatory Certification?
Jan 14, 2012

I was told by someone who attended a recent ICD-10 academy (for trainers) that the OIG is requiring all (current) coders to be certified by the October, 2013, ICD-10 implementation date.  I am aware of the OIG's compliance guidelines, but nowhere in that document do I find anything about mandatory certification. Also, I am not sure if they meant certified in ICD-9 or 10, but it is my understanding that the last ICD-9 CCS/CCS-P exam will be given in March, 2013, and at this point nobod ...

Mandatory Credentialing
Oct 16, 2012

I was thinking... mandatory CMT credentialing might not be a bad thing.  I'd have no problem passing that exam, but would the Indian MTs?  If CMT were a requirement for ANY MT transcribing/editing US-based medical dictation, I think we'd lose our Indian partners pretty quickly. If AHDI could ("would" is probably more appropriate) make this happen, I'd gleefully pay CMT dues and attend all the seminars, etc. ...

What Are The Mandatory ADT Fields?
Feb 25, 2013

I interpret mandatory fields as being those in the upper area that says mandatory plus any fields listed in the CP as mandatory. I interpret the lower fields listed as optional ADT (Alt I) as optional unless stated in the CP as mandatory. But, 99% of these have been in the Alt I fields, i.e., optional fields ...
