Fighting Nuance would be just the same as the current Transcend Lawsuit. For those who are not involved, the latest news did not look good. They are trying to get it thrown out on the basis that because we are independent contractors kind of, the situations vary greatly and we should not be allowed to file as one unit. The attorneys for Transcend feel each MLS should file separately. Well, since we make slave wages, who the hell could ever afford an attorney? So, they have found every way possible to screw us....

Keep fighting those bloodsuckers! Eventually - a way to beat them will be found! n/m

Nice try, Transcend, consult the IRS laws and try to explain why, if we are IC's, why have you been withholding our taxes and probably investing them to your own benefit, eh?

Speaking of independent contractors, when I first got into this field I researched exactly what it meant to be an IC... and what I found was that companies aren't allowed to just have IC's so they don't have to worry about taxes and health benefits and such. You are only allowed to have a certain percentage of your employees be independent contractors, otherwise, you're just making everyone be IC's so the company doesn't have to worry about all the extra stuff that comes with having employees.

I don't mean to rock the boat, but I've long held that this was one of the ways they screwed us over was by using this tactic, and I personally think the IRS should shut that down so these companies have to actually pay unemployment tax, help with health insurance, and follow all the rules the rest of the companies in America are supposed to follow. Having a company of IC's drags down the cost of transcription because company A that is just IC's can charge far less for their transcription than company B who plays by the rules, gives their MT's holidays, vacation time, insurance, etc. So, when a doctor goes to hire these companies, who does he pick? The cheaper one... which makes it impossible for the legit companies to get business!

I know I'm alienating a huge population of IC MT's, but this is how I see it.

Actually, it's not bad news. In wage and hour lawsuits, this is just one of the steps that it goes through. The defendants have to file this motion just as a matter of "covering the bases" but no one expects it to fly. In order to meet requirements of a class action, we just have to prove that a body of people (the MTs) were all similarly situated and similarly wronged. I'd not stress over this, I feel sure the class action will be upheld.

There was an email a few months ago when they filed this, just an update. I hadn't heard anything for a while either so I emailed them and asked for the status, and they emailed me back. I'd email either of the primaries, Russ Riggan or Mark Obermeyer, and ask them. They are super helpful.

I am part of the original 13 that have a lawsuit against Transcend. When the class action was decertified recently, I asked the lawyer with the law offices of Kevin J. Dolley in Missouri about MTs filing in smaller groups or individuals filing alone and if they would have to pay by themselves. The answer was no. It would still depend on whether or not the case was won, and the lawyers would take their fee out of the winnings. So if you think you have legal issues, please look into this. It could be beneficial.
