This has been a long time coming. There is no reason at-home MTs can't be afforded the same worker production as on-site employees. Bring 'em down!

I think it is great that people are taking a stand, but my question is this. If the MTSO is forced to pay minimum wage, can't they just fire anyone who doesn't make enough lines to make minimum wage?

The law is that they must pay whatever minimum wage is in your state. My last job, we were paid a flat rate for the first 6 weeks. They considered it training time even if you were earning more by CPL.
If Nuance could afford $3.1M to buy out Transcend, they can afford to make up the difference while you are learning new accounts.

It would be wiser, more productive for all of us to post to MT-Generated Facebook and/or Twitter account sites, where we won't be censored, and our posts won't be removed, relocated. It's difficult enough to keep open, conistent communication about illegalities and injustices committed by these MTSO's, and the steps we're taking to stop them, without having to deal with an obviously biased group of moderators.

If after your training period is over then you still do not make more than minimum wage, then yes, they will have the grounds to let you go.
I think what will be the sticking point is if the company has a very strict schedule that you must work - and whether that can be proved - and if there is no work during that schedule. I haven't read a lot about the lawsuit against Transcend, but I believe it is absolutely illegal for a company to insist that you work a specific schedule and then when there is no work during that schedule, require you to stay on the clock for additional hours to meet your production requirements and yet not compensating you in some way for the extra time. The problem is going to be having enough documentation to prove that.
It's a very murky area since we are essentially piece-meal workers.

I just started with one of those companies, and if I don't quit soon I might head for nearest psych ward where there is no time clock and no QA nonsense. :)

I need to do something, I worked for Transcend, then Nuance, and then Amphion. I actually had my doctor tell me Monday that he thinks my job is literally killing me. I have been flat out ill for several months now, and he wants me at this point to stop working and apply for disability.

some ICs would like their rights validated, as well. We are ICs, but treated like employees. I know one lady who was threatened for not making her daily line quota as full time with termination. In order to keep her job at all, she was "forced" to go part time, taken off the lucrative accounts she had been doing for 10 years, and put on some very difficult ESL accounts where it was felt she could not make enough money/lines and forced to work every weekened, work a specific schedule, and forced to work days she was supposed to be off, just to be able to "keep her job." So can ICs be included in this lawsuit, as well?

not the same as employee, but there are legal standards as far as IC status versus employee that an employer MUST comply with. So yes, do contact the lawyers involved, even if you are an IC!!!!! ICs should get paid for cc's for example, same as employees, etc.

I quit Amphion, but it was still during the hourly paid training period; however, I did not make minimum wage at Webmedx...not even close. I have friends there (now Nuance) who are struggling to make ends meet. I couldn't agree more with the deterioration of this profession, our wages, schedules, etc.
I may not have much to offer except my experience at Webmedx, but I will definitely google that law firm and contact them. Thank you!
