situations. The underlying policy is that you will be required to sit and wait for work all the time in order to keep 40 hours (and thus your benefits). It eliminates the option to be released from shift with no pay.

How long until Nuance adopts the same policy and will they be dumb enough to put it in writing also I wonder.

You are forced to claim another shift to make up hours, therefore, you are not "waiting" for work. You agree (by being given no choice) to come back later, so there is no waiting around time and no way we can fight it.

because they are so over staffed for all shifts there is no work available round the clock. So they then would have to pay us to wait, which they won't do. They would rather us just not work at all.

I believe you are mistaken about that.

Full time W4 employees are not on call, not receiving compensation for being on call, and are not required to "flex" their work schedule when the company demands adherence with the hours of that work schedule. If you show up to work, there is no work - they owe you down time for waiting for work, you are not required to flex those hours and make up any work outside of your schedule.

All I can say is contact your state unemployment office. You are hired for a shift, a time frame. If there is no work in that time frame, you are considered "underemployed" in my state and can collect benefits. I spoke to someone directly and would have tapped into that, but luckily I was offered a different job and took it.

Document when there was no work. Call your state's unemployment agency and they will tell you what you need to know and what steps you need to take next. All you have to do is document your hours truthfully, represent yourself truthfully and ask if your state considers this underemployed, ask them what happens next. If you don't ask, the answer is always no.

And if you don't believe me, call Wage & Hour and ask them. This company does not own your life, if they require you to sit there with no work they have to pay you an hourly wage for doing it.

They have said you can use pto or make up time. If you don't work later in the day and don't get your hours in, you won't have a job long. They are not forcing you to sit there and wait for work.

If they require you to sit there waiting for work and you have none, they owe you down time. Period.

You DO NOT have to use PTO, or flex your schedule. The schedule you have for working was established by the company you work for - and they either have work for you during that time period or they do not. If there is no work you can take off without pay, but again if they make you sit there waiting for work they must pay you an hourly wage when you have no work.

I don't know how to say that any clearer.

They cannot make you make up the time, or force you to flex your time. If they fire you for not having 40 hours - you win the unemployment lotto.

may vary from state to state. Call your local UI office and find out what the rules are for you, and also if you can receive partial unemployment if your pay has decreased dramatically as of late....
