Coping with NSA situation - PoorMT

How are you all coping with this NSA crap? Giving up Friday evenings to try to make up hours is just not always possible. Sometimes there are too many hours to make up anyway. Most of my PTO was used up before they decided to let us take unpaid time off. Second jobs? Using PTO? I know I am not alone in this situation, how are you all handling it?

I am not using PTO when there is no work! They over-hire and send to much overseas to keep me busy, then I will collect unemployment.

I am not going to sign out for hours on end when I am scheduled. I am willing to make up a couple of hours but not 20 or so.

They need to handle staffing better or pay MUP, though MUP is no great deal. I would really like to make more than minimum wage for being on hand for 60+ hours a week and being lucky to get 20 hours worth of work.

I thought we were in trouble if we were into MUP (even though it is their fault). I time in and out and in and out just to keep my lines per hour in the range they want them to keep my pitiful little job.

They want you to do that so they don't have to pay partia UE. Just to be sure they can't make us clock in and out when there is no work, I'm calling my division office in Tampa, Dept of Labor, tomorrow a.m. and asking this question. I want an answer once and for all. If they can make us clock out when no work, then oh well.

in order to force you to keep clocking back in and out - for your shift, they must

compensate you. Either an average line count for the time spent or an hourly wage (minimum or whatever).

They cannot make you sit there for the remainder of your shift and not pay you for that said shift. If you are scheduled 8 and you only get 1, and then you spend another 7 checking back in and out, then they must pay you for those 7 hours at minimum wage being the lowest.

I would get it in writing as to what the protocol is. If you are released after the first time there is no jobs, then file for unemployment.

DO NOT USE PTO TO COVER HOURS WHERE THEY DO NOT PROVIDE YOU WORK. You also do not have to try to make up that time on opposite shifts because that is easy for them.

Please let me know the answer as I am in your same general location. It seems to me that the Dept. of Labor will have a lot of things to say and you are to be commended for "wanting an answer once and for all". We need one !!!! I have been asked to clock out unless I am transcribing and I have NOT been doing that and don't want to !!!

yes on my team/accounts we are told to clock out if there is no work and are required to continuously check throughout the shift for work. I used to work the night shift, but after acquiring my 6th account and still having no work on night shift, at no fault of my own, b/c they didn't have the work for me to do, I was in "trouble of loosing my job" b/c I could not make up my work during the daytime hours. I had to change my work shift, rework my family schedule (which is not an easy task with 6 kids, 2 of which are toddlers, 1 a baby and a disabled husband) just so I would have work and while the pay is crap, at least I have something now. Its bs that we are required to make up our work hours/lines on our off shift hours b/c they send the work over to India, and even will admit it, however they will say b/c the US side can't get the work done fast enough. I beg to differ, its cheaper sending it offshore than to pay us the night shift rates, which are crap anyway.

I clock in at 7:00 and clock out at 3:30... NO MORE THAN THAT. I don't even clock out for 30-minute lunch, which I never take anyway just to get lines in. They don't pay enuf to even do research, hence leaving MULTIPLE blanks and I NEVER USED TO LEAVE BLANKS. Always took pride in my work. not so much anymore...blankety blank blank blank!

one out here with nothing most of the time? I filed for partial unemployment but I really don't know what that is going to do for me yet. Every week on certain days there is no work so I am having to flex flex flex PTO PTO until all used up, etc. I have read of some of you getting minimum wage due to OOW, can someone tell me how to achieve that? TSM looking into transferring some of us to other TSMs. We lost a rather large account and have been running into OOW a lot. Hoping I don't get called. I really, really like this TSM and don't want to have to learn another group of accounts. Are there other areas that need to have more people on it or are we going to just push that group into more OOW? Hope they study this carefully. ...

Can't remember exactly, but maybe 20 years or so ago, the IRS focused on MT companies using ICs, did audits on them and some wound up paying bigtime. As a consequence, the practice of using ICs in the MT industry all but disappeared for awhile, but obviously it's gradually crept back.
