patient name in the report - nope

What do you think of a company that tells you, as a rule, to put the patient's name in the report when stated because the hospital requested it despite HIPAA?  I haven't been doing it, and they haven't called me on it yet.  They probably didn't notice.  Tongue out

I work two jobs and they both want the patient's name in the report if dictated, as did my previous job. I'm not aware of any HIPAA rule that you shouldn't. Is there one?

I've worked for hospitals where they wanted me to change it to "the patient" or leave the patient name as dictated. I have always done what is asked per account specs. I'm betting they will notice and will most definitely call you on it.

A name in a report is NOT a HIPAA violation. HIPAA doesn't say anything about that at all.

In the first place, names aren't the only thing protected by HIPAA. There is likely to be enough information elsewhere in that report to identify the patient.

There is free training available online.
Second, PHI has to be disclosed to unauthorized persons. Until there is a breach, there is no violation.

Agree. There is way too much misinterpretation of HIPAA - -- sigh --

If the report ever goes to court, that will prove (as much as you can) that the report is for THAT patient and wasn't just put in the wrong chart, under the wrong header or whatever. For good business and legal practices the patient name really should always be used!

Huh, well the employer is the one who told us NOT to put the name in because of HIPAA; so I guess they don't know what they are talking about. lol We get confusing rules back and forth, do this, no don't do that now, ok do that again or it's an error... sheesh
