No Pay For Job With an Error - kdthorn

I work for a company whose policy is that if you make a mistake typing in the job number or date of service or ANY demographic information, then no matter how long the report is and how long it took you to type it and how much you struggled to undertsand the ESL dictator, they pay you absolutely ZERO, ZILCH, NADA for it.  Is that even LEGAL?

This could be legal, especially if there is an EHR involved. Any of those elements being incorrect misdirects the report and makes it unavailable for patient care. It would be wise to check it out with an attorney well versed in employment law.

I would think QA will scrutinize each job more viciously than normal, given that if they find a comma,ASPIRIN for aspirin, i.e., PATIENT instead THE PATIENT, semicolon in place of a period, etc. With this mindset, virtually all jobs would contain errors. QA now has an even more lucrative incentive to dock the MT. MTSOs will get to have & eat their cake, too ... 99% jobs will have been done for free.

As for the question of legal, I don't see how this could be legal, esp. if you are employee status .. still have to pay you minimum wage.

Yes, I'm employee status. Not sure what to do about this. If I consult a lawyer they'll just fire me. Dang. I will keep track of all "no pay" jobs and when I leave the company will ask a lawyer if it's worth going after them for the pay or not. That's the best I can come up with.

there is little you can do about it while still working there except "like it or lump it". However, we need to track every incident of docking us pay for an unrelated mistake.

While I don't know if it is worthwhile consulting an attorney, there is nothing to stop you from reporting this to the labor board.

After you leave or just before, notify the MTSO that they are breaking the law by not paying you, that you are reporting them to the LB. If they refuse or ignore your complaint, follow up your threat. It's worth a try; why should the $$ go into THEIR pockets??

Any MT that signed a contract saying "no pay for any error" would be insane. And yes that would be a great way for MTSOs to get their work done basically for free (still have to pay QA though). But agree this is wrong, presume they have had a big problem with MTs entering the patient info incorrectly and hence the harsh punishment.

Then let them enter their own ****ing demographics - UNPAID WORKER

enter demographics at my main IC job, comes up automatically, my PT job I do have to enter patient name/DOB but I have a patient list to reference at least and I do get paid for the lines so thankful for that. I have worked other IC jobs where you had to check the demographics and make corrections if necessary, but have never heard of anyone screwing you out of pay for an error there, especially when you don't get paid for that part of the report in 9/10 cases. The suits are definitely good at thinking of ways of taking more money out of the MTs pockets, and lining their own with more as you know the client is still billed for the report the MT was not paid for.

If a doctor makes an error (minor) with a patient, I'd like to see the patient try to not pay the bill.

Considering they aren't paying you for the demographics to start with, requiring that to be perfect or you forfeit pay for the entire job is a bit much.

Why do MTs even need to now the patient name, the medical record number or any other patient specifics? The demographics should be 100% the dictator's responsibility to insure it is correct and if HIPAA was on top of their job it would be mandatory that no patient specifics would be included in any document handled outside the originating medical office.

Yes, I guess it's a big problem if the demographics aren't right, like the job number. The patient name comes up in the report (usually correct but not always) so long as you enter in the correct medical record number. But if the job number or date of service is off then there's no pay for the entire job. I did a job that was 178 lines and got zero pay for it because I accidently put in two 3's instead of just one in the job number. Seems like these things should not be the MTs responsibility. It should come up automatically with the job. No worries though, because I just found out this company is losing 70% of their accounts and I'll most likely be laid off anyway and will looking for a new job soon.

Let's see - Ok: You are hired/contracted a certain rate of pay for a certain amount of work, which is measured in LPH. Yet, they throw in a bunch of extra work, demographics, etc. They give you the ole story: "It's part of your job, albeit unpaid, if you want the job." Catch: BUT make ANY mistake on the UNPAID portion of your job (which should not be your job at all, but don't want to offend/charge the client} - well, you won't be paid ANY of your PAID work associated with that error. Do I have it right??

That's pretty much the same rhetoric all companies sell. They figure they can hire you at a line rate and then throw in uncompensated tasks and call it "your job," and it's king's X.

The irony is - the companies and their employees are specialists in "language," yet no one seems to understand the difference in the meaning of "job," and "favor," in addition to "mandatory," and "voluntary."

Job: A unit of work for compensation.

Favor: An act of kindness beyond what is due.

Mandatory: Required by law or rule.

Voluntary: Proceeding from the will or from one's own choice or consent.

Since the standard compensation for work performed is established as a per line figure for work produced, any uncompensated work is more or less a favor, and should be voluntary.

A good attorney could have a field day with this . . . if they only would.

Has anyone ever had this error?  The company I hired on with installed ES v 9 on my computer.  For some reason error 372 popped up when he went to open ES.  He tried a few things, but nothing worked.  He is supposed to get back to me when he finds a solution.  Has anyone else encountered this before?  If so, what did you do to fix it? ...

I am so frustrated!!!  I have a new job, and it looks like I am going to have to look for another one that does not use Editscript V9  because no matter what tech support does they cannot fix it.  They have even spoken to Escription.  I have 2 computers and neither one will work with ES 9.  Unbelievable.  One is less than a year old, and the other one is a few years old.  I have googled this error and tried all the things suggested and nothing works.  I ...

1-second Job Error

Every once in awhile, I get a job that is 1 second long with the error stating that the audio has failed to load.  I click okay and it's booted back in the pool only for it to be placed second in my queue.  This can go on all day.  Anybody else have this happen?  ...

An Error I See A Lot

An error I see very often while doing QA, even though it has no impact on patient care, is a missing comma after the year on a full date, or missing comma after city and state.  I'm not trying to nag, just trying to help because, when audited, the powers that be will ding you for this and laugh maniacally.  Here are the rules in the style guide and BOS for any who want to argue. Well, the head tech guy called today and remotely went on my computer, and he could not find a solution to this error coming up when opening Editscript v 9.  It will not work, so I cannot work.  I have a new job, but I can't work because I can't get ES 9 to work.  Funny thing is, it does this on both my computers, and one is an XP and one is Vista.  What are the odds both computers would give this same error?  The tech guy said they have never seen this error b ...


How I Fixed Error 372

As posted before, I had error 372 on opening Editscript version 9.  Well, tech support couldn't fix it, escription couldn't fix it, so I fixed it.  I did a system recovery where I basically just wiped everything off my computer and started all over.  Vista was basically reinstalled and it was like it was when it was new.  I reinstalled my antivirus and word.  Then when tech support installed ES 9, it worked.    ...

I left a report pending with a note to the department supervisor to have the doctor review and advise.  QA monitors pendings to make sure they're not forgotten.   Our QA system is very different from that of other MTSOs.  This is the dictation that I questioned: "The right external iliac artery could not be visualized.  In addition, the bilateral external iliac arteries could not be visualized."  The examination was done on the upper extremity arterial system. ...

Thought I was going to make it through today with no Major error but no such luck.  I typed "There are" and they heard "The"  Trust me either way the sentence says the same thing and in no way changes the meaning of the sentence so I get dinged a major error for this.  I really hope these quality people get good bonuses for these type things.  Just another major error to add to my very long list.  More in the last 2 weeks then in my entire career of being a transcription ...

There is no consistency in the grading of reports.  And again I say, this is a subjective error...someone heard it, I did not and it does not matter anyway.  Doctors do not dictate complete sentences all the time.
