suing on a board that is NOT anonymous and full of PROFESSIONAL people.  I know now that the rude and stupid responses I got were...well...stupid! lol!!  come on people!

Is this about being surprised you are expected to work hours - you said you would work? SM

Some boards, the posters automatically take an MTs side, wether MT is in the right or not. As an IC if you do not want to work certain hours, why in the world would you say you would if you had not discussed this with the recruiter. Sure, as IC, you dont have to work schedule. You can say, no, I cant work xx hours until xx hours. But I will get on and work when I want to. And just how many MTSOs will go to the hassle of hiring and training you if that is your attitude?

Also, the OP's indication that she would work and then failing to do so is, IMO, a contributing factor to why MTSOs overhire for accounts; the lack of MTs to actually show up and work as indicated. Attitudes like the OP's, IMHO, make it hard to blame MTSOs when they do overhire because they know that possibly a significant portion of those hired will actually fulfill their contractual obligation to show up and work. Lack of performing as agreed upon impacts all of us on an account when things like this happen and the account falls out of TAT.

Is telling someone you'll work for them at x time and then not showing up at x time and THEN complaining when they no longer want you to work for them!!

Seriously? In what industry would that Ever be an acceptable business practice?

If a plumber, electrician, hair stylist, doctor, etc ever did this to you I'd bet you'd go find another service provider, wouldn't you. As an IC MT, that's what you are--a service provider. If you're not going to provide the work when you said you're going to, don't be surprised that you don't have a job.

When MTs don't show up, IC or not, that's when contracts are lost and the hospital decides to go with another service. Hence, MANY MTs are then without a job. I have worked in the business for over 32 years and have seen MTs who will be "missing in action" for a week, but boy, comes the end of the pay period and they sign on and expect to work and wonder why they can't get work. The polite and correct thing in this case would have been to notify your supervisor by phone or email and explained to them that you had an unforeseen emergency and that you would be on as soon as possible. To just "blow it off" no, you have absolutely no grounds to sue.

Is the MTSO in the wrong? Did you tell them you only wanted to get on - and work when you wanted to? Their response?? nm

as opposed to childishly calling the responses (which were not at all childish, rude, or stupid) stupid.

If you were a PROFESSIONAL you'd have had a contract submitted to the client and written so that there was a penalty clause should they decide to unceremoniously (and appropriately) kick your butt to the curb.

A PROFESSIONAL shows up when scheduled to show up.

A PROFESSIONAL treats her peers with respect.

A PROFESSIONAL doesn't ask for a response and then decide to deride those who took the time to give one.

A PROFESSIONAL knows how to run a business and as such doesn't have to come ask questions like, I didn't show up when I said I would and was taken off a vendor list. Should I sue.

Just makes no sense and your response actually provides more insight into the issue.

I did my last ASR for MModal last Friday and started my new job today. My heart goes out to all of you trying to keep your heads above water with Mmodal. So I finally get my check.  I say finally because after many emails they admitted this week they held my training pay a payperiod.    So this check should've had my training pay, a full week and another half week's worth of work. This is what I have been complaining about for a while now -- that my ASR accounts are HORRIBLE.  They are not even putting out anything that makes sense, lots of gibberish, sometimes made-up words, and is taking a huge amount of time to edit this bunk.  At least now some other accounts are doing the same thing and I know I am not nuts.  ASR is regressing.  ...

Some KSMTs posted they got paid today, some got paid on the 1st. This tells me this was not an issue with late line counts or the payroll guru asking them to kindly roll payroll ahead a few days. Truth has to be they do not have the money available to make payroll and had to pick and choose who to pay based on the money available. Evidently it is an unwritten rule at my company that when you are asked to work hours outside of your shift, or over 40 hours, it is a given that you are to do so with no extra pay.  Should I bring it up?  Am I the only one?
