How and where do you report a company - MTneedbreak

Posted: Apr 11, 2010

that do not have you fill out a time card and make you work 18 hours a day to get your line count without paying overtime.  Is this against the law?  I was told to get my line count or else, but it is impossible on the account I am on.  I can make it if I work 18 or more hours a day,but I am not being paid for all these hours and there is no time clock or varification of hours or anything and we are made to work the weekends without overtime pay, etc.

If you are not an hourly employee they do not have to pay overtime. I would think you would need a time card regardless; your employer could be in trouble without any kind of documentation for hours worked. I would suggested contacting the Attorney General's office in your state or the Department of Labor. Assuming that you are not the only employee, you may be able to file a class action suit.

Wrong. If you are an employee and work over - SM

40 hours, you have to be paid overtime. Being hourly has nothing to do with it.

You are probably right and I am misunderstanding the laws. I did research it on line before I posted but as with most things there are exceptions to the rule. Salaried employees such as managers who are paid a flat monthly wage do not get overtime where I work and many of them put in 50 hour weeks. At my office, OT has to be authorized first. Years ago when I applied to one of the MT companies (before Rodeer became Webmedx) they told me flat out in the interview that they did not pay overtime. I don't know if that was legal at the time, I didn't go to work for them. It really doesn't matter, what is happening to the OP is just wrong, anyway you want to look at it. I think companies get away with this because they do business out of states where the labor laws are not enforced very strictly. Not keeping time cards on people is not very smart at all, that may be illegal.

Apparently true or MQ sure wouldn't pay it. - anon

I think the best place for you to start would be to call your local State Labor Board on Monday and ask them about it. They should be listed in the phone book under the State Government section, or you can probably find their number online at your state's dot-gov website too.

This is only if you are an actual employee though. If you are an IC, the Labor Board won't be able to help you.

are you seriously working 18 hours a day? What company? - nm

Yeah curious. You must be on an awful software program - MTIda

[ In Reply To ..]
I am kind of going through the same thing. I sit here for hours and think I am really making good time/lines and then see only 140 lines. What's up with that. I finally figured out it is because there is so much to do before I even get into the document and then when I do it's either a 3-6 line report, or mysteriously, I do a whole page report and end up with 20 lines. Supposedly, I'm paid 65 character line with spaces. I think NOT. Maybe we work for the same company. You can privately email me if you want.

Contact State Department of Labor - This is not legal

Whatever state you live in, contact that Department of Labor. They are in violation.

Sounds like where I'm at. This VBC is killing me. I'm finally at only about 10-12 hours a day but was at around 18 while learning the account and dealing with being switched from pool to pool. No praise either for getting your line count, just more threats if you do not. Mandatory weekends, too, or else. Are you on a VA job?

I work 10-12 hrs/day. When I told my co. I should be - getting paid overtime, they said - sm

I "should be able to get that amount of work done in 8 hours", and if I'm "too slow to get it done, that's too bad". Except that their accounts are horrendously difficult, and their software is a NIGHTMARE. And I'm NOT a newbie - been at this for over 20 years, and I know how much work I'm capable of doing, and I know why I'm being slowed down. It's the software, and all their nitpicky little rules for each client.

In addition to putting themselves in jeopardy of having the Labor Board breathing down their necks, they're also shooting themselves in the foot by making their platform so slow and so complicated. To stay within turnaround, they have to keep hiring more and more MTs. If they'd just simplify their program, so that we can do what we're trained to do, and what we're paid to do, (transcription, not physician name/address research and dufus-data entry), we'd be kicking some serious transcription butt. But no, they're too focused on all the bells and whistles to even have a clue that it's tripping up all their MTs.

Definitely illegal - newvhmt

This is illegal. The same thing happened to me, and I had to quit and contact my labor board. They, in turn, contacted the labor board in the state where the company is located, and they have started an investigation. I live in a town where there used to be tons of sock mills, and they all paid by production. I worked at some of them, and they had to set production at a rate that you would be able to achieve within a couple of weeks. In the meantime, if the employee didn't meet production, the company had to step in and pay the difference to make sure the employee got paid minimum wage. After the training period, if the employee still couldn't make production, they were let go. They were definitely not allowed to work 4-6 hours over their shift to make production. The same applies to the transcription business.
Well, its about time some of these MTSOs got a firsthand - look at how those laws are implemented.

They've been on my case for the last few months, and I've just about had it. And when I have, the ______ will hit the fan in a very big way. I don't let things go -- and can hold a grudge for 20, 30, 40 years if necessary.

sounds like we work at the same company.. - tiredoftyping

My company's platform is horrible. It's slow. We also spend way too much time looking up physician info, etc. To me, that's the hospital's job. I am not paid to be a medical secretary. If the dictator cannot put in the correct info, I shouldn't have to spend 10 minutes trying to find it. Too many rules, slow platform, not enough pay. I'm tired of working 10--12 hours also for fricken base pay.
