Anybody heard of this for Independent Contractors? - klownmom

In order to comply with the standards and criteria the Federal Government has set forth to determine who qualifies for IC status, MD-IT has designed a couple of very basic questions to see if an individual is eligible to be classified this way.

1. Is your business incorporated, a LLC, S-Corp, or Partnership, with a separate FEIN, or are you a sole proprietorship with a registered DBA (fictitious name)? If yes - can you provide evidence of such? (copy of registration, IRS notice of issuance of FEIN, business license, business tax return)

2. Do you make your services generally available to the market? If yes, can you provide evidence of operating a business (e.g. business card, advertising, business phone listing, business stationary, other)?

On the norm, an IC contracts with many clients. I do not have a business, but I am classified on my tax return as self-employed and write off business expenses.

You should not really have to provide this information to a client. MDI would one of your clients just like a physician would be if you had private accounts.

I'd tell them it is none of their business how you market yourself and find another client and/or online MTSO.

MDI is the contractor. You are the subcontractor.

as self-employed as you pointed out. A "client" (MD-IT) in this case has every right to confirm that. Would you hire a contractor to work on your home who couldn't provide answers or evidence of his/her business?

Quite honestly, it is their business if they decide to contract with the IC to take on their work.

All they need is a SS# - so they can write your pay off.

They don't need copies of anything. I have not once had anyone request copies of a business license or my marketing material.

You don't have to own a business to be an IC.

And if you can "prove" either one, then you also have the right to enforce all of the laws which apply to ICs, which include not being required to work a specific schedule and you tell them what your line rate will be.

If you take a minute to look up the ARRA and HITECH law you will find that this status is about to change and that ICs will now become Business Associates with all their attendant responsibilities. I have been told to incorporate and to buy E&O for myself by my accountant. The power to enforce has been extended and I think that taking this advice will be the best thing I can do if I choose to stay in this industry. Companies who hire ICs are not forthcoming or choose to ignore it.

When Nuance bought Webmedx they said they intended to keep the Independent Contractors. They have now "laid off" the last of one, with no notice. They were able to get around the 2-weeks notice by laying them off instead of officially terminating them. They talk about re-instating them "soon," but since Nuance has no other independents that the one they inherited with Webmedx, I certainly have my doubts about any reinstatement. ...
