TTD contractors and other CA contractors who are owed - $$$ - see message

Posted: Aug 22, 2012

Here are the two places you need to contact.  File those claims!  Don't let these cheats get away with this.  and MOST IMPORTANTLY contact the companies who contract with the company who isn't paying you - I'm sure they would like to know the (lack of integrity) of the company they are dealing with.

TTD nonpayment - waiting

[ In Reply To ..]
We had to sign a paper saying we would not contact the client. I'm assuming since the breach was done by nonpayment first, that we would be okay, but I'm not sure about that.??

You need to take the anger out of it and do things - proper. First send them

[ In Reply To ..]
a certified, return receipt demand letter for the money you are owed with a 10 day deadline. If no response or resolve, then go and file a small claims complaint in your town where you live. If you go contacting their clients, this could put you in a very bad situation. I understand you're angray and this would seem like "revenge," but don't even tangle yourself up with that. Take the proper steps and either you'll get paid or this company will have many, many judgments against them. If a prospective client is doing any due diligence if thinkingt of contracting with them, these judgements for nonpay will be a huge red flag.

I know it's a difficult situation and I've been there too (with nonpayment), but don't let that anger guide irrational actions.

Good luck!

There you go...if enough of you file judgements against - her, that in and of itself will

[ In Reply To ..]
either drive her out of business or definitly slow it down quite a bit. As the above poster said, all those judgements against her will send a red flag to the client.

The above poster makes a lot of sense. Even if you dont get your money right away it will at least put a stop to her continuing to get over on other people.

Like the rest of you, they owe me money too. I agree with not contacting the client - just because they broke their contract with us does not mean we stoop to the same level and break contract with them.

I am considering whether it might be worth it to contact SGS, since they are where TTD gets the overflow and are not the hospital network itself. Additionally, anyone who was hired by TTD through their graduate program or school might want to consider contacting the school and letting them know of their experience so that TTD is removed from any lists of approved companies for contacting new grads.

This is a throw-away email, unattached to my normal business. Any other MT owed money by TTD, please feel free to contact me directly if you wish. The more of us who connect and share experiences, the more leverage we will have to try to get a resolution to this.

Not stooping if contact is broken - Ex TTD

[ In Reply To ..]
Just to clarify, since nonpayment actually breached the contract...then there is no contract anymore. So, we aren't stooping to anyone's level. The contract does not exist since the minute nonpayment was an issue, it made the contract void. Just clarifying on that.

She owes my team THOUSANDS of dollars. Am planning to go legal

You have to understand that if you can't find her you can't serve her. - sm

[ In Reply To ..]
That's the problem. If someone can find her in Shaver Lake, CA which is supposedly where she lives now THEN you can file a small claim, etc. Otherwise, as an independent contractor write it off as a bad debt. That's what I'm going to end up doing. A process server can only search so far otherwise you have to get an attorney which costs money. She's probably laughing at this but I'm a huge believer in what goes around comes around. She'll get hers eventually.

Actually, if attempt is made to serve her a company - address and any other due

[ In Reply To ..]
diligent addresses and she does not show up or never signs, you can go to court and end up with a default judgment against her. My guess is, the default judgments will come easily.

She doesn't actually have to be served, but due diligence needs to be satisfied in an attempt to serve her, that's all.
Ha, that's funny. Great, so then I would have a default - sm

judgment. Whoopee. Does no good if she can't be found.
Eventually, she will be found. They are always found. - Dont let her off the hook. nm

What I said is not guided by anger nor irrational actions. I've been in this situation and I have done exactly what I have suggested to these people who are getting burned.

Contracting companies do not check for judgments against bidders LOL. So what you all say about how these judgments for non-pay will raise a red flag to a company thinking about contracting with AK is incorrect. THEY DON'T CHECK!! All she has to do is go to Nevada, New Hampshire, wherever and file for a new LLC and the past is erased. Companies don't do background checks - they award to the lowest bidder and ask when they can start. If they did, every one of us would have to jump through major hoops to get IC contracts - make sense now? She is no different - she is an IC who subcontracts out.

She has breached the contract by non-payment. There is no contract anymore between TTD and these ICs. I'm not sure where you come up with it would put these people in a bad light contacting these companies TTD contracted with, but it most likely would result in a thank you for looking out for their business - and could even end up with a contract.

I've been in business successfully for 24 years as an IC with my own accounts and also subbed for others. If you let fear guide you, you'll never prosper. There is nothing AK can do to any of you legally because she caused the breach. People, contact those links I provided and get your money.

My heart goes out to you all. We work too hard to be treated this way. Has anyone looked into "Theft of Service." Perhaps this could be handled that way, by reporting to police and filing a complaint for theft of service. After all, IC/subcontractor is a service. Perhaps you can go to avvo.com and ask a lawyer for free advice on this. I've used them in the past many times for advice and usually get 5 or 6 replies within hours. Just an idea for you. Hope it helps. God bless you all and good luck!

Thanks for this advice about theft of service. Amy did steal our money and we should report it to the police. We are not employees, so it is not considered a pay check...so yes, as ICs, she did steal our services by not paying us. CALL THE POLICE IF YOU HAVE NOT RECEIVED YOUR CHECK.

For the last 4 pay periods, my checks have been a week late. I was due one on 09/15/2012 and don't have it yet. I have sent a boat load of IMs and e-mails to AK but I have not gotten a response. AND when I request jobs to be transcribed, I get a message "no jobs were found for this request." THIS MESSAGE HAS BEEN COMING UP FOR TWO DAYS NOW!! Does anyone else out there think that it is unusual for a LARGE hospital to have NO JOBS to transcribe for two whole days? so this is my situation: Checks consistently running late; no response for days and days to my enormous amount of e-mails and "no jobs" message when I request jobs to be transcribed (and this has been going on for two days)!!! HELP`!! need some feedback as to what to do.

Good that you got paid though late. She has not paid to many people including one offshore vendor. I am one victim of AK. Waiting for someone to sue her. If I can get the support of other victims I wish to do it myself

How Do I Pay Other Independent Contractors??

I am a self-employed medical transcriptionist. I work for a single practice as an independent contractor. Anybody Heard Of This For Independent Contractors?
Nov 17, 2009

In order to comply with the standards and criteria the Federal Government has set forth to determine who qualifies for IC status, MD-IT has designed a couple of very basic questions to see if an individual is eligible to be classified this way.  1.  Is your business incorporated, a LLC, S-Corp, or Partnership, with a separate FEIN, or are you a sole proprietorship with a registered DBA (fictitious name)?   If yes - can you provide evidence of such? (copy of registration ...

Independent Contractors And Nuance
Jun 06, 2012

When Nuance bought Webmedx they said they intended to keep the Independent Contractors. They have now "laid off" the last of one, with no notice. They were able to get around the 2-weeks notice by laying them off instead of officially terminating them. They talk about re-instating them "soon," but since Nuance has no other independents that the one they inherited with Webmedx, I certainly have my doubts about any reinstatement. ...

Should I Hire A Tax Pro Or Do Most Independent Contractors
Feb 18, 2013

This is my first year filing taxes as an IC.  It seems over my head, but maybe just because this is my first time.  I really would like to avoid the 250+ my local tax person wants to charge and apply that amount to the taxes I will be owing.  So is it that difficult or should I just let the pros do it?  Thanks ahead for any advice ...

Question For Independent Contractors
Sep 13, 2014

To the independent contractors out there...How much do you usually average per hour when being paid per lines?  I just recently took a job a new company, what they offered in cpl seemed to be decent, but once I got working the software they use is extremely hard to get a good line count.  It seems I just keep typing (and/or edit for the SR) away, but the lines take forever to add up.  I think we are paid 72 characters for line, no spaces, no headers/footers, and you ...

I worked for DIT from 01/10 through 03/10.  I quit when I didn't receive my first paycheck on time.  At this point DIT still owes me $278.  From the other posts I've seen, it looks like DIT Transcription has been doing this to their MTs for a couple of years now.  They just brought on a bunch of new clinics, yet my final paycheck from them bounced.  To add insult to injury, my bank charged ME an NSF fee.   Both the South Carolina Labor Board and State of ...

FYI For Others Owed Money By Omniscribes. Sm
May 01, 2013

Filing fee plus service fee for small claims in Bexar County, Texas, is $96 and according to the clerk I talked with, you can include recovery of that amount in your claim. This has gone on for too long. She violated her contract/agreement with us when she continually missed the payments, so any agreement not to let others know about this is void. Obviously, the best way to avoid having people post about an MTSO and her late paying practices is to be on time with your payments. ...

Anyone Ever Pay Monthly Taxes For Taxes Owed
