speak to their accountant and/or make an appointment with an IRS enrolled agent to discuss their liability when they file taxes next year. If KS sends out W2s misrepresenting this as earned income and they haven't sent the payroll taxes, the employee could be liable at the federal and state level. It happened to me when I was fresh out of school and didn't know better, and I had to send in copies of my pay stubs to resolve it.
