I don't believe their claimed percentage of HIPAA violations are caused by the business associate, rather, our having to be complacent with their unwillingness to communicate with clients does enable breaches. If we can not leave a blank for a CC and the dictators only blurt out one foreign name, which could be the first or last name, you are going to have breaches in sending the report to the wrong provider. We do not have the ability to contact the client without being fired, to ask "which Dr. Smith in Dallas" do you want to cc and the MTSO refuses to take responsibility by not setting standards their clients, such as requiring they provide a full name of a provider they want cc or they will get a blank. I wish audits would clean up the source of these breaches and not just fine a business associate for something out of their control unless they are willing to do something they will be fired for. It's about time the providers clean up their sloppy dictation and MTSOs quit being such cowards that they cannot communicate with their clients.
