Many states have labor laws that address the issue of employees who are required to be on-call. In many cases they must be compensated, especially if being on-call means that they are not at liberty to go about their normal activities or are restricted and inconvenienced in other ways.

Companies requiring "flex" are often in violation of these laws and in my experience the state regulators are very willing to pursue complaints related to this.
