Let's say you worked for TTS last year as an IC but left to go to Nuance for the insurance. However, your earnings are significantly less than they were at TTS. You can still file for under-employment, and they will go back to TTS to pay for your unemployment benefits. That's how it is in the state where I live (PA). And if you have low work volumes for a week or two around the holidays, you can still file for those weeks. Let the officials decide whether you're an employee or IC.
