I would first send a demand letter to HR. I hadn't received anything from the DLSE after I filed, so I sent a demand letter and they contacted me right away and said they were sorry I had already filed or they would have settled with me beforehand. It might be worth it to just see what their settlement would be. My claim was reduced by about $4000, but I am terrible with negotiating and just wanted to be done and out of there.
