What constitues an ethics violation? - angry

Posted: Apr 21, 2010

Hello,

One of my friends here at MQ was just put back on 100% QA after one bad audit.  Now, due to First Time Right, she will be making 3 cpl less for ALL HER LINES since it all is going to QA - except for that 10% allowance that she has.

This is just SO not right!!!  How is anyone supposed to live on a pay cut like that?  For 8-9 cpl, it's a 30% pay cut!

Is this reportable to anyone?  (If anyone would care...)  What can we do about this - besides quit?

could be wrong but - sm

I do not think it will count against you if you're on 100% QA. I remember reading something like that. You might have your friend ask QA lead for clarification. That doesn't sound right.

It's true per MQCentral.... - angry

She checked with her QA person today who verified it (and the QA person had checked with her CCM).  Maybe I'll ask my CCM to see what she says.  But per MQCentral in the First Time Right FAQs...

Q7: Will 100% QA rules applied for performance issues and/or for newly trained on ASR impact the QA submission rate for the MTs?

A: No MT will be placed on a QA rule due to being newly trained on ASR. However, reports routed to QA due to an MT rule of 100% QA will be counted toward the QA submission rate for an MT.

I guess she will at least get minimum wage.

It does count against you - 12yrmt

I was moved to a new account and put on 100% QA until I passed my first audit, so I checked with my CCM who told me that it would count against me because I'm not a new hire.

omg does this mean - mt

that because I have a dictator that is on 100% QA, that all his charts that I type are going to QA and counting against my submission rate?

Please say it isn't so. I didn't even think of that!!!!
Not if it's a dictator rule - 12yrmt

It won't count against you if it's a dictator rule. It counts against you if *you* are on 100% QA for any reason other than being a new hire. Here's an excerpt from the FAQ on MQCentral:

Q2: Are there any situations in which a submission won̢۪t be counted against an MT̢۪s QA submission rate?
A: Yes, some jobs systematically routed to QA are excluded from the QA Submission Rate calculation. These are:
â€Â¢ Jobs that are paid by report
â€Â¢ Jobs selected and routed to QA by a Quality Coach for audit purposes
â€Â¢ Client Rule
â€Â¢ Dictator Rule
â€Â¢ Work Type Rule

what I would do ... sm - deg

If I was your friend (and if it happens to me) -- would go ahead and fail next audit in hopes of getting fired.

I collected more on UE than I do working FT here, so at this point being fired might be in my (and your) best interest. We aren't being "compensated" for all this stress either !! Sick of playing their games.

If this were me, I would go to a lawyer. MQ has been messing with its employees for a long time. They persist in doing it because they know they CAN. No one stands up to them. It is darned near time someone did.

State laws? - angry

[ In Reply To ..]

I don't think she will go to the lawyer because she's so scared right now of making waves and losing her job.  But unfortunately, I don't know what else to tell her....I wonder if there are state laws about this sort of thing?  I tried looking on my state's Dept of Labor website, but all I could find were ethics for public officials....I'm not sure where else to look.  And my CCM hasn't answered me back yet... Hmm....

Although MQ is unethical in doing this - that is not the legal question here

[ In Reply To ..]
It is a labor question, under what circumstances if any can they dock agreed upon wages, etc.

Any use calling the Ethics Hotline... - angry

[ In Reply To ..]

...or will I just get the corporate runaround?  I tried calling it yesterday, but you can't get a live person - you have to leave a message.  You don't have to leave your name or anything, but all calls are recorded.  I just hung up!

I called them - CA-MT

[ In Reply To ..]
They told me they can't say anything against MQ as they are employed by them. They are basically psychological support. They will help you deal with your emotions, but they refuse to give legal advice against MQ.
Employee Assistance Line? - angry

Are you sure this was the Ethics Hotline, or was it the Employee Assistance Line? I think the Employee Assistance Line can help with psychological stuff, as well as any family issues that you have, etc.
Oops, you're right. My bad. nm - CA-MT

Lawyer's advice... - angry

[ In Reply To ..]
Well, I emailed a lawyer who gives free advice. He said that although it was unethical and immoral, it was not illegal unless the pay goes below min wage. So, they have to pay her min wage at least. We'll see if they do that...He also recommended she find a lawyer in her area to consult with.

You are paying QA.... - angry

[ In Reply To ..]

MMEs make 3 cpl to review reports....that means that the 3 cpl pay cut that the MTs are taking to send stuff to QA is going to pay the MME!  That is not even right... The MTs are paying the MMEs to fill in their blanks, or to do their reviews if on 100%.  This sucks....

Is This A Breech Of Ethics?
Jan 28, 2013

I want to apply to work at the hospital I transcribe for via MM. Can I tell them I work on their account and have for years? Is this some kind of breech of ethics? Can I tell them I work on this specialty in our town and not specifically say the name of the hospital? Does anybody know. Anybody else done this? I would not be applying for an MT job, just a general clerical or PSR, anything to get my foot in the door. I just love this hospital, familiar with the docs, want to work there, but ...

Question About Ethics Regarding Billing, Etc.
Jan 18, 2011

I have just recently started working at a doctor's office.  I do the transcription.  Sometimes when I have a report on a patient who has BCBS insurance, the billing person will come in and tell me to go back into the report from a few days back and take out one of the two x-rays dictated and to do a seperate x-ray report with a different date.  To me, it doesnt sound right.  It raises a big red flag.  I do not work in billing and I am new to the office environment, ...

MModal Work Ethics

If certain people feel strong enough, maybe CNN's Morgan Spurlock would be a good person to contact.  I've been watching his program on Sunday evenings, and the last one had to do with unions.  I'm not for unionizing (bad experience a long time ago), but many things brought up during the piece were relevant to our experiences working with MModal.  Check him out and see. ...

Violation
Apr 08, 2010

I received an email too 2 days ago from ccm needing an explanation of why I had a patient's report open when I was not actively transcribing.  I know there was a night when I had signed out and I had a window still opened that I did not realize was opened.  I had minimized the window in case I needed the document again to refer to.   Geesh.  sometimes I don't even feel like wasting my time to search old reports.  I feel like its constant harrassment lately ...

Ethics Question About A Life-threatening Issue Posed By Teacher

Hello everyone! I'm an MT student who doing a bit of research for one of my classes, and I wanted to ask some real MT's about this one. My teacher posed to us this question: "What if you were privy to information in the same setting of transcribing 2 different clinics who apparently have a shared client, and you found out something about the patient that you perceived as seriously potentially life threatening?  What if there was a medication prescribed in one contex ...

Has Anyone Ever Reported Someone For A HIPPA Violation? (sm)

The daughter of a friend of mine works in the clinic that I worked at for 18 years in medical records is known to read charts and then tell others about what she has read.  For example, someone who has an STD that she knows, she has told lots of friends about it and I have heard it myself.  Does anyone have any idea what happens when you report someone for a violation?  I am sure that they take the person's name who is reporting it but can you tell me what else is ...

Dictating With Kids In Room - HIPAA Violation?
May 26, 2013

So I just took a HIPAA course regarding the "new rules" regarding our liabilities and obligations under the law.  I often get dictations by doctors who are obviously working at home with their kids running freely (and loudly) through the room, and perhaps a caretaker's voice now and then.  If its a HIPAA violation for ME to have other people listening to dictation, isn't the doctor dictating in the presence of others who obviously have no business hearing that dictation a rep ...
