HIPAA Compliant? - BH

Posted: Apr 23, 2014

From what I am hearing, if you have an XP computer, you are not HIPAA compliant. It violates regulatory requirements. Then why is MM not supplying us with Windows 7? My XP computer they gave me was freezing up, so they sent me another XP. I asked them why they didn't send me Windows 7 and they said XP was cheaper. So now as of April 8, they are not HIPAA compliant. I would like to know how they get around this,,,,,,having many accounts and still having many employees submitting reports using XP. If they are saying they are bankrupt and not able to issue Windows 7 computers to everyone, then still they are saying everything is OK and MTs are still using XPs to submit reports,,,,not being HIPAA compliant.

I wish everybody would drop this because I love my XP! - sm

I absolutely HATE 7 and especially 8. If they were worried about HIPAA compliance, they wouldn't be offshoring work to countries where HIPAA does not even apply. If they'll send the majority of our work overseas and risk patient identity theft, etc., I doubt they're too worried about which operating system we're using. JMHO.

I spoke to the HIPPA compliance person and she said it is not in violation of HIPPA that the IT people could take care of any problems that arise. I asked her how this could be? She said the IT people could take care of any upgrades, etc.

I also asked her how it is HIPPA compliant when dictators are dictating at home when in the background, we hear Dancing with the Stars or criminal minds on TV, someone washing dishes, baby crying, children playing, dog barking. The reply I got was I couldn't prove it, that I did not see where they were dictating. If the hospital knows that a dictator is taking the files home, then that is a violation and they will warn the dictator. I quit asking questions because the answers made no sense.

It is not a HIPAA violation to use XP until there is a breach in confidentiality. So, with hackers having an easier time hacking into an XP computer it is probably just a matter of time before this happens.

the files are sent to India,,Phil in India sees everything...HIPAA is not enforced outside the US..They have all the information handed to them on a silver platter.. And THAT is the reason I dont like my files going overseas..

XP is not HIPPA complaint. Google it and read about that. nm - PA

Windows XP & Microsoft - Beach Glass Lover

[ In Reply To ..]

Some large corporations, such as GE, have an ongoing agreement with Microsoft.  For a per-system fee, they continue their XP support and will continue to get regular security patches and updates. While I'm not convinced that M-Modal would go that way, it is always a possibility.  That being said, for the average user and/or MT, we are on a slippery slope.  I doubt highly a hacker would try to weasel into this middle-aged housewife's laptop in suburbia, but who knows.  With a majority of the world's ATMs still running XP, I think hackers have bigger targets available to them.  (However, I have upgraded to a Windows 7 system, just to be on the safe side. )  Since Microsoft themselves has stated that XP is no longer compliant, and this isn't new news or surprising news, I'm stunned how many MTSOs didn't hop on the bandwagon 6 months ago and give all their employees/contractors a heads up, options, or basic information about the situation.

I have heard it is very expensive for Microsoft to provide - MTMI

security updates so who knows. I updated to Windows 7 and bought a whole new computer because I just don't trust anything when it comes to government regulations if anything happens. Mine was very old and just about done for anyway so this forced the issue to get a new one.

IMO, the reason MS isnt supporting XP anymore, is so we are forced - to buy a new operating system. SM

If they kept providing these free updates and patches, there would be no reason for most to buy a new Operating System. Not as much profit for the company, so of course they had to come up wit a way to force many to buy from them again.

I does not surprise me to think for the right amount of money, you can buy your way around no updates or patches. EVERYTHING is about the money. And the distance between who has it and who doesn't is growing.

I found an article from a computer magazine - L&L

on line which indicated Kaspersky would support XP until September 2016.

It is not a matter of being HIPAA compliant, it is simply a matter of being protected, and supposedly Kaspersky does that.

That isnt the same as the patches that Microsoft sends out though. nm - MT

Hello, my doc is finally going digital after three years of begging him to! HIPAA - Need A Quick Check On HIPAA Rules
Oct 29, 2009

Hi, I need a quick check on HIPAA rules.  With respect to the health care debate, I want to write to my senator, etc., about a situation with a patient I transcribed on.  The only info. I intend to give is that the patient was a:  Russian immigrant, on welfare and receiving Medicaid benefits--when he should not have.  He and his "sponsor(s)" was responsible for his care and living expenses.  Further, I transcribed a note in which the doctor said that this patient wanted to re-sched ...

My husband went in to have blood tests done for a new blood pressure medication he is on and when he left the house to get an RX filled, the nurse from the doctor's office called to tell him the results of his blood tests. Not only that, I then asked her what new medication had been prescribed and SHE TOLD ME THAT ALSO! M ...

Regarding HIPAA - This Is Important For MTs
Jan 28, 2010

if we are to be held responsible for any kind of so-called 'security breach' which can be so easily manipulated to either just get ridf US MTs or at least make life a iving ____ for those of us left in these jobs (for example, if your reports are not 100% perfect - because 98-100% would no longer make sense because an error is an error and all are a security risk and breach - (this is so ridiculous I almost cannot even write it)); however, an MT can and will be fired for such?  Im ...

Question About HIPAA
May 29, 2010

I had to take my 18 year old daughter to the ER the other night because she cut her finger (not seriously thank goodness).  Being a medical transcriptionist I was rather surprised, she was not given any type of HIPAA form to sign, was not told anything about HIPAA, I thought everyone had to sign one.  I always have received a form when I went to the doctor or the hospital but she signed absolutely nothing.  Is this something new or is it a HIPAA violation since she did not sign an ...

Question About HIPAA Rules
Jan 13, 2010

Couldn't we just leave a note on any report with a cc to "please verify physician name for copy" which would then take the burden off of our shoulders? Not a QA marker, but by doing Ctrl + Shift + Q. I plan on leaving a note for anything that is questionable at all, ie., only last name given, unclear, cannot verify, whatever... HIPAA Data Breach
May 02, 2010

I am reading far too many cases of MTs being fired/threatened for copying the wrong doctor on a report.  While this constitutes an error, it does not (NOT) constitute a HIPAA breach.  HIPAA law is being wielded like an axe by misinformed management, with the regulations being used to threaten and fire a huge segment of the American workforce.  MTs fired for a "cc" issue need to report their job loss to their state labor department as well as the department of health and human se ...
