So much for holiday pay - Fatigued Fingers
Posted: Jul 04, 2014
So here I am, on a holiday, OOW on all my accounts. So much for that so-called holiday pay.
when you get a job, stay clocked in, do not clock out - Nuance is ripping you off

If you are an employee, just clock in, you must be paid. They will not like it, but it is the law.
They will not pay you - Do not listen to them

This has been tried again and again. All that will happen is that your lines for the rest of the week will figure into today's hours. So, say you typed 1500 lines per day for 4 days (6000 lines total) and you had worked 32 hours those 4 days. That's right over the minimum lines - ~187 LPH. But then you're OOW all day today, 8 hours, and are clocked in and actually waiting for work to come in. That'll just mean your 6000 lines now gets divided by 40 = 150. If most of those lines are straight transcription (unlikely, but go with this), then even with dividing it by 40, you're still above minimum wage and they don't have to pay you MUP.
Say that it's all editing. Then unless you're getting paid WAY more than the rest of us, that 6000 lines will equal about $240, which divided by 40 hours = only $6.00 an hour. So, they'd have to give you about $50 in MUP. But I can tell you from experience, if you have that much MUP, they'll look at your time card and wonder why and see you had zero lines for today but 8 hours on the clock. They'd either ask you to delete the time or give you a warning/write up.
And even if they did give you the $50 MUP, true, that's $50 more than you would have gotten, but is it worth a writeup, the low lines, etc?
They have got us in a vice grip and there's not much we can do. I mean, if these large corporations can get away with hiring all independent contractors and no employees, despite the IRS code clearly stating that these people need to be employees, not IC's, then what makes us think we're going to get anything else? As long as we make more than $7.25 (Federal minimum wage) an hour, they don't care!
If you are OOW and - are short hours, though

As long as you are not logged in they won't divide it by 40, right?
Example: Inasmuch as I want to accrue PTO, I realized that what is the point of trying to get the 40 hours so you can accrue more PTO if your lph decreases so sharply, whether because there is no work and you are logged in OR the work you sit waiting for in drips and dregs is terrible and unfamiliar, and your lph goes way down.
I read the OOW thing again and realized they are basically giving you license to clock in, if no work check again in 15 minutes and you are free for the day - WITHOUT pay of course.
But I have taken to doing this on OOW type days and then coming back on only if my primary has a decent amount of work in it so I can get at least another hour or so of work that won't sink my lph. As far as I can tell from what I have been doing, as long as you indicate the OOW, if you are under 40 hours you are not required to take PTO and the OOW log-in/email procedure accounts for that time.
Even though you are not accruing as much PTO, what's the point of doing that when your rate will be in the toilet when you do take the PTO and also your pay will be down because of low lph?
Sometimes I can do almost as many lines in 36-38 hours as I do in 40 hours if I am not sitting there scrambling for garbage work but only log back on when I see there is enough to make it worth it. So basically it's more of a quality than quantity thing, except for the slightly less PTO accrual. Also, it spares you the demoralizing process of sitting there waiting for the odd job to come up rather than being away from the screen for awhile. I do not use Nuance benefits, however, so not sure if it would impact on that if you work under 40 hours through no fault of your own.
There have been times when I have had very low work through the week or another situation requiring me to make up time and when work is slow and you know it runs out Friday midnight that is pretty awful. You just cannot win with this company, they find a way to get you no matter which way.

Regarding "But I have taken to doing this on OOW type days and then coming back on only if my primary has a decent amount of work in it so I can get at least another hour or so of work that won't sink my lph." How can you tell if you account has a decent amount of work or not in it of if you have any work assigned to you without contacting your manager?
On my platform - I can see the work

On the different accounts. I don't usually get work assigned except at times when it is very backed up for any particular account, which has not happened for awhile. The work just comes automatically, stats, primary, secondary, etc. I believe it is first come, first serve.
You can actually see the jobs on the different accounts on my platform. You can't assign it to yourself or anything, but it is helpful to see basically how much is there.
When I do my usual shift I don't even look at it, just log on and do my 8 hours, but when there is no work and it is dribbling in, it is good to be able to know what is on there.
If I have a period of OOW on all my accounts (I have 4), when I look later on I can either just live with how ever many hours I have done and not use PTO due to the OOW, use PTO, sit there waiting for work here and there, OR wait until (if ever) the work builds up a bit on my primary, in which case I just log on and try to get up to 40 hours.

Where I live it's $8, soon to be $9. State law trumps federal.

What they care about is that you make the minimum wage for your state (mine is one of the highest), not the Federal min wage. So I have to get way over 200/lph on a regular basis, not easy sometimes with VR, but I have not had MUP since last October and I am retiring soon. Because I have to push so hard to get minimum wage for my state, I get a lot of nit-picking errors, commas, etc. I failed a post audit recently because of a missed "the." Don't anyone out there argue that you don't get dinged for something like a comma and "the" maybe you don't but I do, in fact "the" could have been a major error, can't remember. First holiday I have worked for a while and feel very frustrated. The last hospital I worked in was really fair the way the handled holidays. Everyone had to take turns at holidays but you only had to work 4 hours and if there was no work you still got paid. For example, if you worked your 4 hours on Thanksgiving, then you didn't have to work Christmas or New Year. Happy days!
Here's the deal...my company says if/when you work a holiday, they will give you the equivalent hours in PTO to use later on (you work 8, you get 8 PTO). I checked with my state's DOL, and they said absolutely incorrect. You must be an exempt salaried employee for them to do this. They must pay regular employees cash money. The DOL also said that unless the company is a licensed health care facility in my state, which they are not--they only contract with ...
15 PTOs full time per year. Do we get Memorial Day or any holidays on top of that? If I look hard enough I could probably see it in all the paperwork, but it is Friday and I am lazy. Thank you very much! ...
I generally work every holiday, and most of the time the work is rather low, but today it has been rather brisk. Thinking that I might actually make a decent wage today, I was trying to remember how our holiday pay was set up or if Memorial Day was counted as one of their "holdidays."
After searching my own files as well as ENRICH I finally found it: It is. We get the enormous increase of.... wait for it.... 25%! Wow. So, for editing that's just ar ...

Last holiday (Labor Day) I was paid a differential. It is usually time and a half so going by your base you will see an additional line on your paystub of holiday lines: ex. if your base rate is 0.08 you will see holiday pay 0.1200 x 1000 lines. As far as I know, we have not received any notification that we do not get holiday pay. ...
me where to find the holiday request off rule --not more than 60 days or something like that. I cant find it on MQ Central. If you know the rule or how to find it on MQ Central that would be great!! ...
Hi. My CCM sent out an email saying that work loads were going to be low because of the holiday and that we could take PTO for Monday if we wanted. My question is what if you don't have PTO? Does that mean you have to work the holiday or can you still request it off and just not get paid for it? I would ask CCM but she said she would be very busy and wouldn't be able to keep up with emails.
Thanks ...
I have always gotten paid time-and-a-half for holiday pay on the Fourth of July, which is one of Medquist's holidays (or so it is listed as and always has been), and was told by CCM we would be paid time-and-a-half for that Monday's work done since even though it wasn't the fourth, it is when it is nationally celebrated. However, on today's paycheck I did not get any holiday pay at all!!! I went back several years to check and I always got paid this way for w ...
Did all of you have a wonderful holiday with your family or did you get to sit in front of your computer all day waiting for work to come in? If the latter, then here's a suggestion. On Webclock punch in when you started waiting and punch out at the end of your shift, unless by some small miracle you got enough work to make more than minimum wage for your shift. It's legal, it's truthful timekeeping and they must pay you for it. This will at the ve ...
Reading the material about benefits they sent me, they are pretty vague about holiday pay, so what is it - time and a half? 1.5 x lines typed? 1.5 x reports ? Or is it a percentage of that day's production? I've had holidays paid in so many different ways at so many different companies nothing would surprise me, I just want to know. ...
I'm confused about holidays with Nuance. I was told I had to work either Thanksgiving or Christmas when I was hired, but not both. Now I'm getting emails that no UNPAID time off will be granted. I have no PTO right now, so am I to assume I have to work all day on Thanksgiving AND Christmas since they fall on my regularly-scheduled days??? ...

I'm curious how other companies handle low work days. At the company I work for, if we have a slow day (holidays are always slow and have little to no work coming in) we are required to use PTO hours if we have them available. If we don't have PTO hours, we take the hours unpaid. I had 12 hours of PTO. We had no work Christmas day, and I had to use 8 hours. I was told a few days ago that on New Years my account will have no work and I will have to use my remaining 4 h ...
