can anyone explain the email about legal counsel? - sm

Why would I contact one of their attorney's if I were going to start a lawsuit or something?  Seems like a conflict of interest.  Is someone suing them?  Is that why they are informing us "if someone contacts you."

 

I was wondering same thing. Puts thought in my head if something - does happen, do the opposite of email. nm

I dont get it either, but if ever I felt I needed an attorney, I doubt I would be calling theirs. Why would anyone put themself under the spotlight like that, you would be gone in a lickadee split.

I once gnawed my own leg off to get out of the socio-economic bear trap that is MQ and made a run for it. Three wonderful years of freedom, then MModal, which looks suspiciously like MQ (like Superman's disguise of wearing or not wearing glasses), dragged me back in kicking and screaming.

This time I think the key to success is for us all to quit on the same day. That way at least some of us will make it and those that do escape can tell the story of the poor souls that didn't.

"counseling" with "work-related psychological issues". Some of us fell for it, and it turned out to be nothing short of spying on what their MTs were thinking. There was no confidentiality whatsoever. They used the info. we provided in our "counseling sessions" to run interference on any possible lawsuits.

This sounds like EXACTLY what M*Modal is doing. They must have finally discovered just how unhappy we all really are about being treated like dirt, and paid like paupers.

Probably because it's cheaper for them to pay a - settlement than to go to court & lose. nm

Legal counsel for any company is working only for the interests of the company as a whole. They are there for the benefit of the company and to make problems go away.

If you have legal issues such as items regarding violations of Fair Labor and Standards Act, legal counsel should be sought outside of the company against whom the complaint would be filed.

There is no complaint filed against Nuance. The complaint is against Transcend regardless of the fact that Nuance acquired Transcend. Transcend is a division of Nuance, and if a class action was classified it would only incorporate those who were/are Transcend employees.

If you want the most recent status of the Transcend complaint then obtain a free Public Access to Court Electronic Records (PACER) account at www.pacer.gov. The case number is 1:12-cv-03627. This is accessible public information.

I looked up the answer to the complaint which was filed by the defendants' attorneys on 7/5/2012. It is 29 pages long. There is a 10 cent per page charge by the PACER system, but you are only charged if your total pages accessed in a quarter exceeds $15. Stay below that amount and you are not billed.

On 7/25/2012 there was a status hearing. I will put the information of that here.
"Status hearing held on 7/25/2012. Class action discovery as stated in open court ordered closed by 9/24/2012. Class certification motion to be filed on or before 10/19/12. Response due 11/21/12. Reply due 11/16/12. Ruling to be by mail."

So, it appears things are going to go back and forth for the next few months.

I have never worked for Transcend or Nuance and cannot speak to any of the employment practice they may or may not utilize. However, I do think that there is value in keeping oneself informed on what is going on in the industry or any company in particular.

I'm thinking this has to do with a case in which a patient may have sued a doctor or hospital and named everybody and their grandmother involved with their case as a party to the suit. This is is our employer's way of letting us know that if we have been named as a party in a medical suit, to use the company lawyer and not retain counsel on our own. (I'm just guessing).

Do you mean the transcriptionist is being - sued along with the Dr?

In which case, the MT is being sued along with the doctor, or a HIPAA violation, in which case the MT might be the actual target. (Or something of the kind. That would be my wild and totally unsubstantiated guess.)

If an account has been offshore for almost 1 year and is being transcribed by an offshore MT and qa'd by 2 separate offshore qa and then 1 American qa.......where are they actually saving money? How long does the Q need to pay 4+ (the person who audits them too) to do 1 report before they realize their American MTs could get it done in 1 shot and maybe 2 on occasion? TATs are out because of this and there are so many NJA issues spoken of on this site too, WAKE UP Q! ...

in normal human speak?  I consider myself a very fast learner.  Normally I have to only be shown something once to get it, but that????  I watched it twice and I still have NO IDEA what she was talking about with check marks and preferred headings and HUH?!?!?!?!?!? Okay, so if you go below mininum wage, the company has to "pay extra" to bring your paycheck up to minimum wage, because BY LAW they have to pay at least minimum wage. But somehow, when they decide to ONLY pay us for "active typing" "hands on keyboard" and NOT for our research (verification of correct terminology, spelling of names, etc) and our documenation (of errors, questions, blanks)...aren't we entitled to have THAT time spent "made up to us," to bring us up to a FAIR PAYCHECK? What counts against us and what does not count against us.  They are trying to say that a legitimate blank does not count against us and speakers that are on autopend are not to count against us either.  However, what do they mean by a legitimate blank.  I blank if I can't understand/hear what is being said or a discrepancy in the dictation.  However, my account is on a 2 blank restriction...each dictation 2 more or blanks has to be pended for blanks.&n ...

Why is it that I can only work 28 hours as a part timer, but full time people are able to get OT, no limit.  I don't take insurance, don't want it, but there is no darn reason I can't work as many hours as I want also.  This is ridiculous.  Why would the company pay OT to someone when I have 12 hours I could be working at regular pay.  What the??? ...

I was working tonight.  Just me and someone else on the system on my primary account, like always.  The only difference was 67 reports (double the amount) when there is usually around 30 reports every night on the primary account.  I worked for 2 hours.  Got off for an hour and came back on and NOTHING.  I did not get my primary.  How strange?  I go back and look at my primary account and it shows 12 reports are left out of 67 reports in one hour ago.  I ...
