Anyone check with their employer to see how they will handle an MT performing a HITECH HIPAA violation after 02/2010?  Could be $100 fine for each occurence, up to $25,000/year.  HITECH HIPAA violation could be an MT putting an incorrect doctor in for a carbon copy.  I know the doctors are so very thorough in their carbon copy requests, so in that case, there should be very few problems...lol.

I was told the company can pass it on to their MTs who made the error.

There is no way transcription companies can pass on any hitech fine to the MT. MTs, make sure your employment agreement covers this!

When it comes to being fined for incorrect CCs, and I am not given adequate information to do it correctly, I'll refuse to do courtesy copies. Besids, these companies do not pay me for courtesy copies anyway.

Anything that I do free gratis is not part of my "JOB."

Even Websters defines a JOB as: "A piece of work; especially : a small miscellaneous piece of work undertaken on order at a stated rate."

MTs are doing too much freebie work and shouldering the liability for garbage dictation as it is.

When the standard rate of compensation is ZERO, that's what they can expect - NOTHING.

Just found out my employer is requiring all employees to take the HITECH test.  This is from the law that was passed last year.  We were told it would take about 5 hours to complete. How can any company be compliant with HITECH/HIPPA when they send work overseas. Isn't that a HIPPA violation and should the patient be notified that their personal information, diagnoses, history, SS#, in some cases home address, DOB, etc, is sometimes mentioned in reports and overseas MTs have access to it?  How can any company be compliant, especially with HITECH be compliant with these new laws, regulations, etc, when the patient is not aware their information is accessed overseas ...
