Clocking out for KS - NumbMT

Did anyone else receive an email from their coordinator about clocking in and out when there is no work on an account?  Maybe I'm wrong, but if I'm assigned a shift and I'm there looking for work, how can I be made to clock out?  If I have to be available in case there is work those 8 hours, I should be paid those 8 hours and be on the clock, right?  That email seems fishy to me.  If there are no customers in line at Burger King, employees don't clock out and wait for some.  I know I am entitled to minimum wage, but lately I'm lucky to break $7 an hour, and I know my state has a higher minimum wage than that.  Anybody have a reliable source to look this stuff up?  eMTs pulled this on me too, right before the account thta was just "slow" ended up on Epic.  ByeBye work.

If they REQUIRE you to wait for work, they are REQUIRED to pay you to wait. If they let you clock out and have the day off, then you would have to file for unemployment to make up the difference, but this nonsense of clocking out between jobs is illegal and your department of labor will gladly help you with that. I reported my company and they had to pay me and EVERYONE else back all wages for a 1-year period. My complaint was anonymous, so of course the owner told us all it was a "bonus" check when we got the difference, lol. They could call it what they wanted though, it was my only "bonus" check ever and I was at least paid minimum wage after that.

It works to report them anonymously? That doesn't mean they will fix the problem anytime soon, though, right? If the work is not there and the note says "no backup accounts" what do I do while I wait for the DOL? Did they start paying you minimum wage immediately?

No they don't pay you minimum wage immediately, but you will get back pay and minimum wage eventually. The important thing is the big picture and getting them reported so the more MTSOs are noticed for abusing workers and the industry standards can change for the long run. In the meantime if there is no work, there is no work--nothing DOL can do about that. Just keep track of all your e-mails, your time waiting, etc. If you have to find another job or more work still keep your claim open against the current company. It will pay off for everyone.

With me, I went to my local DOL and they set up an investigator to call me and that took maybe a week. She called and I gave her the info. I didn't have to provide any employment records or anything. The DOL then investigated the company by pulling employment records. It was maybe a month later that I got a letter from DOL saying what my wages were that had to be repaid and we all got an email from the company saying how great of a job we were doing and how we were getting a "bonus check". The mysterious bonus check was, of course, the amount they actually OWED me for requiring I sit and wait for their work!

After that, new policy at work that we no longer had to clock out in between jobs. If we didn't have work for 2 complete hours, then we could clock out for the day and they would call us if they needed us any more that day and of course that would be OUR choice if we worked or not. Then, the way it worked was we got minimum wage when we were waiting for work. That whole process took less than 2 months.
Was that KS or another company? The timeclock is pretty new at KS. nm - Curious

us to clock out if there is no work, they also require us to clock out while we are researching and actively working on a file. So with that, it can take you way more than the 8 hours to get your 8 hours in if you have bad dictators. Really stinks!

It is absolutely illegal. Report them to the Department of Labor. Refuse to work off the clock. If you give in to their demands for free labor, you are only enabling their illegal doings. You can report them anonymously. Do it! I once worked for an MT service that was right next door to a large inner city hospital. Well, after we had finished transcribing the reports (cardiology), the MT company made us hand-deliver them to the hospital--right up to the Cardiology Department--(unpaid, of course). One of the MTs who had been with the company a long time was married to a law student (poor woman)--one day she told me she had had enough and was going to the Labor Board. About six months later I--and everyone else who had to be the company's unpaid messengers--got a nice check. As I recall, it came right in time for Christmas shopping season, so that made it doubly sweet.

First of all, I'm not spending any more than 5 minutes on research, so it wouldn't be very logical to clock out for 5 minutes. BUT, if the company required it, then NO research would be done by me...that blank would be put in there pretty fast and someone else can get paid to research it, problem solved.

I'm not a lawyer yet, just a lowly law student, and I am sure that the Bar Association would frown on my giving legal advice without a license. However, I would urge you to make a file--nothing fancy, just a file folder will do--where you can put hard copies of this memo and any such memos that might come in the future referencing clocking off when there is no work. You need to print out a copy immediately when anything like that comes in. I am certain that the Labor Board would be very interested in seeing them.....

They told me the same thing...clock out for a short time then back in to see if any work came. When I have asked for more accounts for MONTHS and have been totally ignored, there is no way I am clocking out. Even meeting their 15000 line goal per pay period, their pay is so low they have to subsidize my income to bring it UP to minimum wage! THEY need to make sure we have enough work, especially when they know you continually run out. Doesn't stop them from sending out those emails saying we are not meeting or requirements and having to explain WHY. If you want loyal, happy, hard working employees, then give them the tools and work they need to do it. Funny how when these things happen suddenly everyone gets a QA! Make copies of emails that document your efforts, even if you think it̢۪s insignificant. They also will not pay you minimum wage unless you fight for it! Sad to think that̢۪s all we are worth now a days...very sad and discouraging.

Funny.....i got an email explaining positive reasons you should be clocking out like phone calles, etc., which made a lot of sence, but mine said do NOT clock out during your scheduled shif if the work is low and keep checking for work to come in. I have in the past been told to clock out. Very confusing....maybe someone read the bord or complained to the DOL. As long as my employeer does what is right and fair, then I have no problem, even if I am in the wrong.

First of all, most MT's at KS have back-up accounts. If you do not, they either do not want you on other accounts because of poor quality (by the way, sence is sense, shif is shift, bord is board). Another reason is that maybe you do not know other work types or have had low QA scores in the past.

They do work with you if you don't have enough work, but they won't help you if you don't ask or are not qualified to take on more. Look in the mirror and ask yourself if you are being fair here. If so, go above her head. If not, fix what you're doing wrong and you will see that it would be much better for you.

You are being honest. I can do several specialities and have backup accounts. Because of this AND my quality, I am an asset to my employer. You people just complain all day. If you want to work at Burger King, please do. Don't keep complaining, reporting, or bellyaching. You do a disservice to our industry.

Clocking Out OOW?

Got an email earlier this week about the OOW situation, how we are supposed to do regular clock out if we intend to make up the time or clock out OOW if we are not planning to make up the time.  Anybody know what's the difference?  I am OOW now and planning to clock out soon.  I already have time from earlier this week I can't make up and now this.  Just want to know what it means.  Thanks. ...

I don't mind clocking in and out, everyone has to do that, but if there is down time that needs to be added to my timecard or the like then that should be their job not ours.  I don't have time for all this unpaid crap. I just want to clock in and do my work then clock out and forget about the rest.  They get paid the big bucks to take care of our timecards if there are additions that need to be added. ...

You are all ready to clock in at precisely the scheduled time only to lose internet connection.  This has happened to me many times, and by the time I have unplugged and replugged and reset modem, and that doesn't work, so had to get on phone with internet tech support, 30 minutes or more have passed by....then what?    OR,  if the power goes out, which can be anywhere from a quick flash on and off to longer....then what?   OR, when getting close to end of shift ...

I'm tired of being clocked in and my benefit rate suffering for it so I am clocking in and out. It will probably affect my PTO since I am part time and don't get any anyway but oh well. It looks like I will be using my benefit rate a lot more than PTO what with all this NJA going on ...

I never clock out for breaks.  Am I supposed to?  I am scheduled for 4 hours at a time with a 1-hour break in the middle.  If I clock out for a break, don't I have to make up the time at the end of my shift?  I don't wanna do that.  I take a break whenever I feel like it.  I can't type 4 hours straight.  How does it work for everybody else? ...

If I am sitting at my computer waiting for jobs to come in every 5-13 minutes, I should be paid. I should not have to be penalized by an adverse effect on my line count if I were to stay clocked in as production. Waiting for jobs while clocked out is still being on the job if you are signed into Fluency. So, the way I figure, you are still working, but off the clock. Plus, as proof that you are working off the clock, your Fluency log in time will be greater than your clocked in time. ...

If I clock out to go to the bathroom, how do I make up the time and stay within my "scheduled hours"?  Just wondering how everyone else works this out.  Apparently, they no have a perfomance checker to correlate when clocked in and actually on what you are doing in DQM now.  Also, does anyone know how to check the time worked in DQM? ...
