Use PTO (if you have it) and get paid for the time, use excused absence no pay and not get paid, or choose to make up the time if you want. You don't have any beef to take up with the Department of Labor because you're being given 3 reasonable options. They won't be able to help you just because you don't like the choice you've been given.
