Who violated the HIPAA law if the dictator gave the wrong information to the MT. Example: They said to send a copy of the letter to Dr. David Jones in Mudville, Arkanasas, but the letter should have been sent to Dr. Davis Jones in Mudville, Arkasas. (If you didn't catch it, I just changed the last letter of the first name).
1. Is the doctor to blame because he said the wrong name?
2. Is the hospital wrong because they cc'd the letter without double checking things?
3. Is the MT wrong because they didn't double check through the Internet, and then flag the report?

it would be on the dictator/facility. If the MT is only given a last name or if the name is not spelled out, etc., it should be flagged by the MT in whatever fashion the client profile calls for. That way, if the when the JCAHO audits the facility, the MT is not responsible.

I do think it should be a violation to send a cc to the wrong doctor, absolutely!! What burns me up is that the responsibility for this falls back on who ???? Not the doctor dictating. Not QA. Not management who could ask the docs to dictate the physician's first name - but the MT certainly. Everything is the MTs fault. Truth be told, some of the docs have no clue who they are writing to and do not care. We have been told to research the last name, city, and IF you have the specialty. This is very very dangerous. IMHO - I think if Dr. Smith is dictated, that is what should go on the report - PERIOD. If they want the first name on there, they should be required to dictate it, PERIOD. They bring this problem on themselves and the responsibility needs to rest with the person doing the dictation. I have even been told to send cc to docs that do not even exist!!!

Have you ever looked up Dr. Smith, Jones, Jackson, Thompson, etc. in any major city? Even in the same specialty? Many with the same first names too. Companies need to back up their MTs on this one.
Go to the link and type in a partial last name and state. You'll get a fairly long list.

cc goes to we are to leave a blank for the cc or, as you said, send to Dr. Smith, Dr. Brown, etc. This is the facility's request. We have been told THEY will do the research if the doctor is not clear, which is the way it should be.

Granted, I have very easy going QA, but if the cc is dictated as simply Dr. Jones, and I have four Dr. Jones in the data base, I put a QA marker and the note "cc to Dr. Jones."
I think I would continue to do that even if I were going to be dinged for it by my QA. I say that now, anyway. If the dictating physician isn't going to give us at least a first name to go by, then someone other than me who has more info on the file can do the research to figure out who that doctor is.

This is one company that recognizes that mind-reading is waaaaaay above our pay grade, and guessing is STRICTLY forbidden.
That's guessing about ANYTHING, not just cc doctor names.

Make absolutely certain that before you sign a contract with anyone, you have a clause added on this subject. If the service refuses, then don't work for them.
Another option might be to type what is said but flag EACH AND EVERY ONE of the names in the cc: section. "Please check accuracy of information" before sending cc to individual.
It may be coming into the Xmas season, but I don't think you want to have your chestnuts roasting on an open fire.

I was just terminated from my QA position for a cc error, Mark Jones versus Mark Johns, no spelling provided, sounded like Mark Jones without question. Wrong. Medical Records Dept should have this responsibility based on signed releases from the patient. Not an MT responsibility.

well, I'm still trying to get my position back, so I don't want to say at this time... it is one of the larger MT firms. I am just beside myself about this.. MT for 18 years and now 1 cc error on a new account and I'm out. 99.7% efficiency, so nothing wrong with the rest of my work.

My question is, is this a case of SEVERE OVERACTION by the MTSOs or is this the case now according to HIPAA?
So are they saying that because a non-treating MD received a report and everyone in the office, wherever, "SAW" that report that it breaks the Privacy Rule and thus a breach?
So there is no need for a warning to the MT who did that but just grounds ...
This may be an obvious question to most, but how do I print a hard copy of a document I recently completed on EditScript? Or can I? I'd like to keep a copy of what "I edited/typed myself" before the QA reviews it, so that I can see my errors and learn from them, or have something to back me up if I disagree. When typing a radiology report, do you send the results/report of a radiology exam to just the ordering provider or the ordering and the family provider? Does anyone know how to forward emails from Nuance's company email program to your personal email for documentation?? I've tried to forward them to mine and it refuses to recognize my personal email and address and won't forward them.
