I can only speak for CA, but call the labor commissioner for your state, may be listed under Industrial Relations Dept. They are there to help you with any questions. If you are in CA, use DLSE form 1 or 55 to file. Essentially, if you are entitled to paid breaks, you should be getting that pay, it is not incorporated into your line rate.
