bought out co. and IRS - in deep

Posted: Sep 21, 2013

Has anybody worked for Alltype (Jerry Kelly) in the past in NJ?  Apparently they were bought out by Medquist or M*Modal in 2012.  I worked very briefly for Alltype in 2011 and then moved on to brighter horizons, although they reported to the IRS that I earned 4x what is actually on my W2 and according to my bank records.  IRS needs me to contact Alltype for verification but they no longer exist (number disconnected)... so what to do?  Something is very fishy and the IRS claims I owe thousands.  Any suggestions, anyone????

you DO have... contact MModal.

Yes I have my W2 and already submitted it to IRS. They still want verification from the company...what is the point of the W2 then? LOL I heard the deal fell through last minute, although she spent a boatload of the money before she got that big fat check. Hummmmm.

Another avenue would be for you to go to your local IRS office and ask to speak to someone from the CRIMINAL DIVISION. They for sure will go after this person. I have seen them do it in the course of my work. They are like pit bulls. If there has been any monkey business on her part, they will find it. They have the resources and personnel to do it. If I were in your shoes, I would go to the criminal division and have her investigated.

Tell the IRS to contact Alltype. You have a valid end of year statement for the time you worked for the company. This is something that the IRS needs to settle between themselves and Alltype/whomever they are now. Tell the IRS you have your W2 and bank statements. Period. Tell the IRS to sort it out with the company.

Just send a registered letter to the IRS with a copy of your documentation and tell the agent that you are unable to contact the company, as they are defunct and bought out by another company.

If you regularly use an accountant, you could give that person a call. But, as someone else suggested, I wouldn't call an attorney. That is definitely going to add up to a bigger bill.

The IRS is notorious for screw ups.

Once IRS said I owed $40-$60 thousand - Karlie

dollars, showed up at my front door. My then husband and I had a business out of our home and IRS tried to say because money came out of the business put towards household expenses, said that I drew the money as employee. Then I worked 2 jobs, one started at 5, ending at 1 and the other started at 5:30 and ended at 10-10:30. Thank goodness I could show my paper trail and got relieved of owing all that.

Talk to the IRS - Ex-MedQuist

[ In Reply To ..]
Several years ago, MedQuist filed a false report with the IRS about me. I hired a CPA who straightened it out. The CPA told me if it ever happened again, I could go right to the IRS. If it were me, I would go to the IRS and tell them what has happened and also send a written summary to the fraud division of the Attorneys General of both your state and the state in which Alltype did business. The IRS was very understanding with me and when they saw that that MQ had said did not match my real records, that was the end of it. Did I ever get an apology from MQ ($400 in CPA fees later)? Nope.

This sounds very fishy. I worked for GK and All Type for many years. sm - Suspicious

[ In Reply To ..]
Yes, they sold to MQ a few years ago. Yes, the owner got a divorce, but before the sale. Yes, MQ closed the local office but the rest is fishy.

The OP says that she was sold to mQ and then says that she "heard" the deal fell through. It did not. GK got her check, but it was probably not a huge payout because the company was not that big.

Something is fishy here. This person seems to have an ax to grind. The other person who kept saying "he" was obviously not an employee of AT ever.

Fishy - AllType - in deep

[ In Reply To ..]
Yes an axe to grind sounds about right. She (Alltype) reported to the IRS that I made 4x what is stated on my W2 and my records.

Perhaps the most accurate way to find out whether something is fishy or not is to bring the IRS into the picture via an audit of the principals involved and the terms of the sale. They have everything they need to audit back for as many years as they need to. Who knows, IF there was fishy stuff going on with you (and I am not saying there was, this is all just hypothetical), there may have been other things with other employees, too. Best to get it out in the open. If there is nothing wrong, it would clear her name.

If you knew ANYTHING about a business, you know that you and the IRS get the SAME W2. - Suspicious

NOT if the business is doing fishy stuff - They get whatever the company sends them
[ In Reply To ..]
There is absolutely nothing to prevent a company from submitting a falsified W2. I've done manual W2's in the past and all it takes is retyping another one with the incorrect figures.

I have no opinion/comment on the above poster's issues, but it is absolutely possible to file a false W2 with the IRS.
Which reminds me, OP you need to check - with SSA to see what they got
[ In Reply To ..]
One copy of the W2 goes to the SSA, so in addition to talking to the criminal division and/or the taxpayer advocate at the IRS, talk to the Social Security administration to see what they got in terms of a W2. A copy goes to them as well.
Why would they do that? - Curious

???
No idea. I am not commenting on the false W2, simply - on the above statement that it cannot be so
[ In Reply To ..]
The post that I initially responded to said "if you knew anything about a business, you would know that you and the IRS get the same W2." I was simply commenting on the fact that it is indeed possible to send one W2 to the employee and an entirely different one to the IRS.

As to why? I got nothing.

could it be duplicate reporting to the IRS? - ex-Signal SE

[ In Reply To ..]
Back in the 1990's, I was a statutory employee with Signal (Dorothy sold that business and went on to start up MDI-MD). They sent me a W2 for the last year, then later I got a corrected W2 (which is a W2-c)showing that the SE box was marked (it was not marked on the original W2). When the W2-c got to the IRS, the person entering the information failed to see that it was a correction and entered it as a fresh W2, which doubled my income from them in the eyes of the IRS. This was after Signal had been closed. I got all sorts of threatening letters from the IRS and talking to them on the customer service line got me nowhere. I had to contact the IRS Taxpayer Assistance Center. Those people do nothing but stand up for people who are having problems with the IRS. One phone call and the rep saw what I was talking about. The pending actions were dismissed and I had a letter in my mailbox in 3 days showing everything was straightened out.

Give the TAC a call to see what they can do to help.

Falsifying W2 or employee income - In deep

Thanks all for your input. A company reporting increased earning on an employee(s) could, especially in this case since Alltype was sold that year, be due to wanting increase outgoing expenses to decreae the amount of profit, or claim a bigger loss due to higher paid salaries..especially the same year as a buy out. That would be to their advantage, knowing a big fat capital gains bill is due that following April.
