IC, if one is required to adhere to a strict schedule/consistent shift, they should be classified employee status and the company is required to pay their share of taxes for that employee. Many of these small companies cannot afford that and why they hire as IC and require services of an employee. Many go along with this due to financial needs and the companies know this, unfortunately. There is the option to submit the information/case to the IRS who will determine if that emloyer has incorrectly classified the worker and if so, will demand payment of the back taxes owed.
