Why do you think there are different guidelines and requirements for the defintion of IC and employees? If they want an employee that is what they should hire, not ask for an employee and just call it an IC. That is absolutely wrong, greedy, and trying to skirt the DOL laws.

Companies have and will be fined for that

And I work as an IC, our company has happy clients, and I do not work a set schedule so don't drink the koolaid. Thirty years in the business and never had a set schedule until offshoring companies got in the mix. Dictators do not and have never dictated in a "set schedule". The work ebbs and flows. Why do you think these "set schedules" have MTs complaining of sitting around with no work.
